FEDERAL BUREAU OF INVESTIGATION

JUSTIFICATION AND APPROVAL FOR

ACQUISITIONS UNDER THE SIMPLIFIED ACQUISITION

THRESHOLD

In accordance with Federal Acquisition Regulation 13.106-1(b)(1), I hereby determine that the Medical Supplies and e-commerce requirement listed on DJF-20-0300-PR-0005070 are available from only one source, and competition is precluded as there are no substitutes available.

1. This acquisition is restricted to the following sole source:

Company: McKesson Medical

Company Address: Memphis, TN

Company Point of Contact and Phone Number: Annette DeLorenzo

2. The medical supplies are estimated to cost $250,000 and are required to be delivered to Medical Operations and Readiness Unit (MORU). The FBI is seeking to establish a 3-month Blanket Purchase Agreement for the fulfillment of medical supply requirements across the

FBI.

This request for medical supplies includes a vast and wide variety of pharmaceuticals, vaccines, diabetic supplies, diagnostic accessories (thermometers), disposable scrubs and sheets, hygienic and sterilization products. The unit's largest category of essential medical supplies includes over-the-counter medications and emergency medications.

3. Specific characteristics of the medications and medical supplies requirement that limit the availability to a sole source are the sheer number of products and complexity of the products that are required and the requirement for an online ordering platform. This request for medical supplies includes a vast and wide variety of pharmaceuticals, vaccines, diabetic supplies, diagnostic accessories (thermometers), disposable scrubs and sheets, hygienic and sterilization products to name a few necessary categories. The unit's largest category of essential medical supplies includes over-the-counter medications and emergency medications. Due to the large numbers of supplies (attached) used on a regular basis a single source is required. Market research and prior purchase history has indicated that only McKesson Medical can supply all of the products listed on the product matrix. It would be inefficient for the FBI to search multiple vendors for products, when a single source can meet the product and delivery requirements. Additionally, efficiencies are attained by having a single point of contact for all 56 FBI Field Offices and FBIHQ.

In addition to the large product portfolio, McKesson Medical provides an online ordering platform for the FBI. This enables the FBI to easily submit purchases, track delivery status, and obtain purchase history data. A dynamic online ordering platform provides the ability to review alternate product availability for back ordered and short supply products. Customers can also review products at various price points. Due to volatility of pricing and fluctuating availability, it is a priority requirement that the FBI be able to have real time options to select between all available manufactures and not depend on a vendor to have to source alternate products.

McKesson Medical maintains an in-stock inventory of the most used items and offer discounts of at least 10% off the government wholesale price list on all items purchased and regular deeper discounts on select items. If an item is not available through an immediate channel, McKesson will search for one and then make the item available. Due to the size & complexity of FBI operational missions these medical supplies are in high demand and require short notice ordering & deliveries. McKesson has been able to meet time critical requirements.

Market research has determined that only McKesson has local warehouses throughout the country and can often provide same day shipping at no additional charge. Shipping of orders in an expeditious manner is a requirement due to pharmaceuticals and most medical supplies have expiration dates. The FBI is not able to stockpile these supplies because they expire. For this reason, the FBI orders as close to the expiration date as possible in order to take advantage of as much of the shelf life as possible, better known as just-in-time delivery.

Whereas other vendors, that the FBI has established contracts with previously, have had difficulty maintaining stock/inventory of products required by the FBI, McKesson has been able to fulfill these requirements via their ability to maintain appropriate inventory levels.

This is crucial to the FBI that has potentially volatile mission requirements and the routine replacement of soon-to-expire products in its (FBI) possession.

Due to lack of inventory with the FBI’s current BPA holder, the FBI has an urgent need to obtain medical supplies for orders that were placed months ago and have yet to be fulfilled.

4. Check and fill in all that are applicable for an Open Market Buy:

The material or service must be compatible in all aspects (form, fit, and function) with existing systems presently installed. The current equipment is <insert description of current equipment>, and the new item/service must coordinate, connect, or interface with the existing system by <insert description of how the new item/service must coordinate or interface>.

A patent, copyright, proprietary data, or licensing agreement limits competition. The proprietary data are described as follows:

<Insert description>

These are "direct replacement" parts/components for existing equipment.

Other information to support a sole source buy:

The FBI has experienced product delivery issues with the current supplier/ BPA holder.

As a result, the FBI has an immediate and urgent need to replenish expiring medical supplies, and will award a sole source contract to McKesson Medical. McKesson has the ability to immediately fulfill the outstanding requirements and those forthcoming in the remainder of FY2020.

5. A statement of the actions, if any, the agency will take to remove or overcome any barriers that led to restricted consideration before any subsequent acquisition for supplies and services is made.

The Government will continue to research the market to obtain as many available sources as required in accordance with the FAR to ensure that there are other vendors out there that can satisfy this requirement. In addition, the customer will do due diligence in ensuring that barriers to competition are avoided to ensure we obtain the best value for the government.
