About this file
This is a Sole-Source Justification document for consulting services related to medical device development under the Blueprint MedTech Initiative for the National Institute of Health (NIH) and National Institute of Drug Abuse (NIDA). The requirement is for a Subject Matter Expert to provide consulting services supporting the development of translational neurological medical device technologies, including feedback to NIH program leadership and technical guidance on medical device development projects within the Blueprint MedTech initiative portfolio.
The justification supports awarding a follow-on contract to Luminescent Consulting LLC, the incumbent and woman-owned small business (WOSB) contractor, under Purchase Order No. 75N95024P00032. The acquisition is a time & materials/labor hour contract not to exceed $150,000, conducted under simplified acquisition procedures. The sole-source award is justified based on the contractor's status as a WOSB in NAICS code 541990 (where WOSBs are substantially underrepresented) and their acceptable performance on the predecessor contract. Pricing will be at standard commercial rates and compared to similar historical contracts to ensure reasonableness.

Revised10/31/2016
FAR Subpart 13.106-1(b)
4. Acquisition Type.
Time & Materials/Labor Hour. This acquisition exceeds $3,500 and not expected to exceed $150,000, and conducted in accordance with FAR Part 13—Simplified Acquisition Procedures.
5. Acquisition Authority. This acquisition is conducted under the authority of the Federal Acquisition Regulations (FAR) Subpart 13.106-1 (b) Soliciting from a single source. (1) For purchases not exceeding the simplified acquisition threshold, contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, or industrial mobilization).
6. Justification Rationale.
FAR 19.1506 states that a contracting officer shall consider a contract award to a WOSB concern eligible under the WOSB Program on a sole-source basis before considering small business set-asides (see 19.203 and subpart 19.5) provided none of the exclusions at 19.1504 apply.
Luminescent Consulting LLC is the incumbent contractor under the predecessor contract, and is a WOSB, and this procurement is solicited under a NAICS code (541990) in which SBA has determined that WOSB are substantially underrepresented in Federal procurement. The expected procurement will not exceed , and Luminescent Consulting LLC has been determined to be a responsible contractor with respect to performance.
It is anticipated that prices for this requirement shall be at the vendor’s standard commercial rate, and NIDA shall compare the proposed prices to similar and historical contracts to verify that the prices are fair and reasonable.
7. Any other facts supporting the justification. None.
