DEPARTMENT OF VETERANS AFFAIRS
SOLE SOURCE JUSTIFICATION UNDER SIMPLIFIED PROCEDURES FOR CERTAIN COMMERCIAL
ITEMS IN ACCORDANCE WITH FAR 13.5
Acquisition Plan Action ID:
1. Contracting Activity: Department of Veterans Affairs, VISN 8, NCO-8, VA Caribbean Healthcare System, San Juan Medical Center, San Juan, Puerto Rico. The Purchase Request I as been assigned for this procurement.
2. Nature and/or Description of the Action Being Processed: This procurement is for Liebert UPS System Maintenance Services. The resulting contract will be a firm fixed price type of contract, consisting of a base period of twelve months and four option periods of twelve months each.
3. Description of Supplies/Services Required to Meet the Agency's Needs: Services to be acquired are for all materials and qualified personnel to perform Liebert UPS System testing, inspection, cleaning, adjusting, repairing and replacing of all associated components as necessary, to keep system in operation, and reliable while maximizing the equipment service life. The contract will consist of a base period of twelve months, and four option periods of twelve months each as well.
The anticipated period of performance for the base period is from September 10, 2025, thru August 31, 2026. The total estimated value (including options) of the acquisition is:-
4. Statutory Authority Permitting Restricted Competition:
FAR 13.5 Simplified Procedures for Certain Commercial Items. The statutory authority for applying the Simplified Procedures for Commercial Items of FAR 13.5 is 41 U.S.C. § 1901 and is implemented by FAR 13.106-l(b)(2) for restricting competition on this procurement. Competition is restricted on this procurement for the reason below:
( x ) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements
( ) Unusual and Compelling Urgency ( ) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert
Services ( ) International Agreement ( ) Authorized or Required by Statute ( ) National Security ( ) Public Interest
5. Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): Technical Power Service Inc is the only equipment manufacturer (OEM) authorized distributor and service representative for the geographical area in which the equipment to be services is located. They have access to OEM parts not available to other third parties as well as OEM certified technicians. Accordingly, Technical Power Service Inc is the only firm capable of providing the supplies and services described in Section Ill above without the Veteran's Health Administration experiencing substantial duplication of cost
