MEMORANDUM

Subj:SOLE SOURCE JUSTIFICATION TO ACQUIRE SPARE PARTS TO SUPPORT
MK 28 MOD 0 UNDERWATER BREATHING APPARATUS FROM INNERSPACE
SYSTEMS CORP (ERP 1300872306)

1. Identification of the agency and the contracting activity, and specific identification of the document as a “Limited Source Justification.”

This is a limited source justification. Contracting activity is the Naval Sea Systems Command, Naval Surface Warfare Center, Panama City Division (NSWC PCD), 110 Vernon Avenue, Panama City, FL 32407-7001 (Contracts Division Code 02).

2. Nature and/or description of the action being approved.

This action will award a purchase order, on a sole source basis, to InnerSpace Systems Corporation, 1711 Midway Court, Centralia, WA 98531 to acquire spare parts for the MK 28 Mod 0 Underwater Breathing Apparatus (UBA) Rebreather Assemblies.

3. A description of the supplies or services required to meet the agency’s needs (including the estimated value).

This contract action is for providing one kit Navy Part# Kit, MK 28 Canister Scrubber (includes ten complete scrubber canister assemblies, twenty five scrubber canister door assemblies for the MK 28 Mod 0 UBA) and one MK28 full head assembly kit. This acquisition totals $101,626 dollars. The Government’s minimum needs have been verified by the certifying technical and requirements personnel. This memo does not authorize acquisition for other requirements. The contract action will be funded with reimbursable 2019 Research, Development, Test and Evaluation (RDTE) Funding.

4. Identification of the justification rationale and, if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service.

10 U.S.C. 2304(c)(1), 10 U.S.C. 2304(d)(1)(B). Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements FAR 6.302-1(a)(2)(iii)(B).

Pursuant to FAR 6.302-1(a)(2)(iii)(B), ISC is the sole provider of the MK 28 Mod 0 and owns all of the intellectual properties for this design. NSWC PCD is designated as the in-Service Engineering Agent (ISEA) for the MK 28 Mod 0 by NAVSEA- PMS 394 to field and maintain the MK 28 Mod 0 UBA. NSWC has previously procured and fielded fifteen NAVSEA OOC certified MK 28 Mod 0 UBA’s. Because this a certified life support system alternate parts are not authorized.

5. A determination by the ordering activity contracting officer that the order represents the best value consistent with FAR 13.106-1(b).

The Contracting Officer has determined that the order represents the best value and results in the lowest overall cost alternative (considering price, special features, administrative costs, etc.) to meet the Government’s needs.

6. A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted.

NSWCPCD conducted an analysis of alternatives for a specialized research diving detachment (SRDD) underwater breathing apparatus in 2009. ISC was the only manufacturer able to provide test UBAs and complete the extensive qualification testing required to achieve system certification. ISC’s MK 28 Mod 0 UBA was certified by NAVSEA OOC in June 2011.As a certified UBA; it is approved for use by SRDD.

7. Any other facts supporting the justification.

NSWC has previously procured fifteen MK 28 Mod 0 UBA’s. The MK 28 Mod 0 is produced solely by ISC. The MK28 Mod 0 is currently a NAVSEA certified US Navy diving UBA. The procurement per ERP Contract purchase number 1300872306 is required to ensure continued support for the certified MK28 Mod 0 UBA’s.

8. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made.

Class system certification for UBA’s encompasses all aspects of the system from procurement to vendor qualification, configuration management, sustainment, maintenance, issue resolution and engineering changes. Class system certification restricts the configuration of the item and source controls the vendor per the system certification documentation. To maintain class certification, there is no planned action to remove the restricted consideration for subsequent acquisitions. To do otherwise would void the certification.
