FOR OFFICIAL USE ONLY - Source Selection Information – See FAR 2.101 and 3.104

(April 29, 2024)

Justification for Soliciting from a Single Source Federal Acquisition Regulation (FAR) Subpart 13.106-1(b)(1) – For purchases not exceeding the simplified acquisition threshold. (i) Contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization).

1. Identification of the agency and contracting activity: The Defense Health Agency, Southern Markets – Contracting Division (SM-CD).

2. Nature and/or Description of Action being approved: SM-CD intends to solicit for “brand name” histology equipment produced by Leica Biosystems. The equipment being ordered will be delivered to the lab at Naval Hospital Pensacola (NHP). This award shall be Firm Fixed Price (FFP) with an estimated total contract value of The action will use FY 24 DHA Defense Health Program (DHP) funds.

3. Description of Supplies/Services required to meet the agency’s needs: NHP has a need to purchase the following histology equipment.

Manufacturer Part No. Description

LEICA 14039357258 HistoCore Arcadia H 100 120

LEICA 14041157009 Power Cord various NEMA5 15

LEICA 14039354116 Magnifier Assembly

LEICA 9CON-SLVR-ARCADIAH Arcadia H Silver Service

LEICA 14041157009 Power Cord various NEMA5 15

LEICA 9CON-SLVR-ARCADIAC Arcadia C Silver Service

LEICA 149BIO000C1 HistoCore BIOCUT Config 1

LEICA 9CON-SLVR-BIOCUT Biocut Silver Service

4. This acquisition is conducted under the authority of FAR 13.106-1(b)(1): For purchases not exceeding the simplified acquisition threshold. (i) Contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization).

FOR OFFICIAL USE ONLY - Source Selection Information – See FAR 2.101 and 3.104

5. Rationale Justifying Use of the Regulatory Authority Cited: The Contracting Officer has determined that based on the circumstances of this requirement, the Government requires “brand name” equipment manufactured by Leica Biosystems (Leica). The Leica histology equipment that is being procured is the only equipment capable of meeting the Government’s needs. The items provided by Leica are the only items compatible with existing items operating within the laboratory. The Leica workstation is the appropriate size for the limited bench space available.

Additionally, this equipment is compatible with the existing electrical infrastructure in the room;

therefore, no additional facilities modifications or costs are required. The lab currently contains and is fully operated utilizing Leica equipment. Acquiring other equipment will require re-accomplishing Standard Operating Procedures (SOPs) and retraining of lab personnel which would lead to large blocks of time where the lab would not be operational for these needs.

Adding to the loss of function and retraining costs are duplication of costs around $150K that would be required due to stocked supplies on site and reconfiguring of the set up. Additionally, NHP has a maintenance contract in place that supports NHP’s lab requirements and services that could continue to provide support services for these machines.

6. Anticipated cost to the Government will be fair and reasonable: In accordance with FAR 13.106-3(a) the Contracting Officer must ensure that all supplies and services are procured at a fair and reasonable price. It is expected The Contracting Officer will analyze various price elements that are presented in the quote, as well as review actual costs from previous and comparable procurements from other Governmental Agencies as well as open market prices to form a fair and reasonable price.

7. Description of the market research conducted among schedule holders and the results, or a statement of the reason market research was not conducted: In accordance with FAR Part 10, market research was conducted on 24 April 2024 through 2 May 2024 by researching pervious purchases through Federal Procurement Data System (FPDS), System for Award Management and discussing the procurement with available sources. During the research, it was determined that at least two sources were available to provide the equipment. The manufacturer (Leica Subsystems) and Government Scientific Source, Inc. stated their interest in quoting and capability to provide the brand name items needed.

9. Efforts to Obtain Competition.

Competition will be obtained by posting a solicitation to System for Award Management. It is expected that at least two contractors will provide quotes in response to the solicitation.
