Sole Source Justification for Simplified Acquisitions (over the micro-purchase threshold and up to the SAT) Template Rev. 1/30/2018 1-1
SSJ No.: FY21-049
Date: 1/27/2021_________ PR Number: _______RWES-21-0036___________
1. Nature and/or description of the item/service being procured and anticipated cost:
This procurement is an urgent and compelling need for Emergency Medical Service Kits to the DHS and in accordance with the requirements designed for the execution of Emergency Medical Services (EMS) supporting National Special Security Events and the rendering of emergent medical care along the Southern border.
2. Sole Source Justification Rationale in accordance with FAR 13.106-1(b)(1)(i):
_________Only one source reasonably available.
___X____ Urgent and compelling circumstances exists.
_________ Exclusive licensing agreement exists.
_________ Brand name. If the brand name requirement applies to a portion of the procurement, please identify that portion.
_________ Industrial Mobilization _________ Other. Explain:
The vendor, D-Dey Response Group, is a specialty Emergency Medical Services (EMS) equipment and training organization which focuses on the development and fielding of remote medical response kits to Commercial Shipping, off-shore, as well as, tactically austere locations where medical self-sufficiency is required for EMS Kits in rugged and field ready packaging.
The urgent and compelling nature of this procurement is further justified in that, these kits require immediate fielding of “shelf-ready” items which meet the DHS EMS requirement for configuration due to anticipated EMS readiness and posture due to a surge of migrants along the Southern Border. The Department has a “One-DHS System” as it pertains to Emergency Medical Services Medical Response to the Department for National Special Security Events (NSSE), requiring robust medical response kits. Given the current environment of medical supply distribution, the EMS Program is seeking to procure these kits in a reduced timeframe without the option of routine government ordering processes in response to a significant increase of migrants requiring EMS related care along the southern border. Failure to field these kits would result in a significant reduction to the Medical Readiness and response capability of Medical Support to the Department, given the expected influx of migrants requiring EMS related care.
Without these mobile kits, there is a near certainty DHS’s medical posture and infrastructure will become overwhelmed due to insufficient resources.
3. The anticipated price will be determined fair and reasonable based on one or more of the price analysis techniques described below in accordance with FAR Part 13.106-3(a)(2):
OPOAM 3013.106-1(b)(1) Sole Source Justification (SSJ)

_________ Market Research.
_________ Comparison of the proposed price with prices found reasonable on previous purchases.
____X____ Current price List.
_________ Comparison with similar items in a related industry.
_________ Comparison to IGCE.
_________ Contracting Officer’s personal knowledge.
_________ Other.
A current price list is available for this equipment procurement, with a determination that D-Dey Response Group was the preferred vendor based on their operational and medical configuration of their product as well as their “Shelf-Ready” posture of these kits, capable of delivering within 24 hours of official tasking. Purchase of EMS Kits through General Services Administration adds unnecessary time restrictions under our urgent and compelling need to provide the Kits to the Southern border. While D-Dey Response Group is not the only vendor with EMS Preparedness Kits, their product possesses unique characteristics which have been tested in Commercial Shipping, as well as, austere environments with great success and are available for immediate delivery and distribution. These kits are currently undergoing review by the EMS Program for application across all DHS EMS Component Programs to include the United States Coast Guard as they meet or exceed medical requirements established by the Chief Medical Officer.
