About this file
Justification and Approval for Other Than Full and Open Competition (>SAT)
This is a Justification and Approval (J&A) document for a sole source procurement by the Department of Veterans Affairs, VISN 22, Network Contracting Office 22, supporting the Greater Los Angeles VA Healthcare System, West Los Angeles VA Medical Center. The procurement is for Emergency Boiler Plant and Continuous Emissions Monitoring System (CEMS) Preventative Maintenance and Inspection (PMI) Services valued at $357,780.00. The contract will be awarded as a 90-day firm-fixed price emergency award to Caldaia Controls LLC, an SDVOSB vendor, with a period of performance from July 21, 2026 to October 21, 2026. The authority for this non-competitive procurement is Unusual and Compelling Urgency under 41 USC §3304(a)(2), implemented via RFO 6.103-2, along with RFO 12.201-1 for simplified procedures for acquisitions valued over the SAT.
The justification emphasizes that the boiler plant and CEMS are critical systems essential to facility operations, providing heating, sterilization, and hot water supply to veterans. Failure of these systems would create significant risk to patient safety, facility operations, and regulatory compliance with the Environmental Protection Agency. The current contractor was unable to perform required maintenance services under the existing contract 36C26226P0776, creating an emergency situation that does not allow time for full and open competition. Market research conducted within the past 12 months identified Caldaia Controls as qualified and capable of quickly performing the required services due to their awareness of the facility's situation. The Contracting Officer determined the anticipated cost is fair and reasonable based on historical pricing data and comparison to an Independent Government Cost Estimate (IGCE).

DEPARTMENT OF VETERANS AFFAIRS
Justification and Approval (J&A) For
Other Than Full and Open Competition (>SAT)
Acquisition Plan Action ID: 36C262-26-AP-8200
1. Contracting Activity: Department of Veterans Affairs, VISN 22, Network Contracting
Office 22 (NCO 22), in support of the Greater Los Angeles VA Healthcare System, West Los Angeles VA Medical Center. 2237:
2. Nature and/or Description of the Action Being Approved:
This procurement is for Emergency Boiler Plant and Continuous Emissions Monitoring System (CEMS) Preventative Maintenance and Inspection (PMI) Services located at the Greater Los Angeles VA Healthcare System (GLAVAHCS) in accordance with RFO 12.201-1, Simplified Procedures for acquisitions valued over the SAT, and RFO 6.103-2 Unusual and compelling urgency.
The Greater Los Angeles VA Healthcare System- West Los Angeles VA Medical Center, requires emergency services from Caldaia Controls LLC for the boiler plant and CEM system PMI. To ensure continuity of services, the Network Contracting Office 22, Services Branch III, intends to award a 90-day emergency, firm-fixed price contract to Caldaia Controls for the Boiler Plant and CEM system PMI services. The proposed contract action will be awarded with an estimated value of $357,780.00.
3. :
The Boiler Plant and CEMS is a critical system that impacts overall facility operations through heating, sterilization, and hot water supply. The boiler system is essential for maintaining a comfortable and safe environment for patients and staff. If the boiler systems shutdown, or no backup system is available, this impacts heating, sterilization and hot water supply to provide for the veterans. A CEMS failure will result in severe environmental compliance violations, legal penalties, and potential operational facility halts.
Preventative maintenance and inspection services are essential to prevent equipment failure, ensure patient safety and comfort through reliable steam generation, and maintain compliance with the Environmental Protection Agency and local environmental regulations.
The contractor must have experience and expertise in maintaining the boiler plant and CEM system and be able to respond promptly to service calls.
The estimated period of performance is 21 July 2026 to 21 October 2026.
The estimated value of the acquisition is $357,780.00.

4. Statutory Authority Permitting Other than Full and Open Competition:
( X ) Unusual and Compelling Urgency per 41 USC §3304(a)(2) as implemented by RFO 6.103-2
5.
Acquisition Requires the Use of the Authority Cited Above (applicability of authority):
Under authority and verbal permission granted by the Contracting Officer (CO) on 07/21/2026 upon receiving the VISN SBAR approval, these emergency Boiler Plant and CEMS PMI services complied with IAW RFO 12.201-1 and RFO 6.103-2 urgency of the procurement. Delaying this requirement would pose a high-risk threat to patient safety, facility operations, and regulatory compliance.
The selected SDVOSB vendor s qualifications are directly related to the specialized nature of the Boiler Plant and CEMS operations and the intricate technical requirements involved in its maintenance. These systems require specialized skills, and technical knowledge.
Given the criticality and complexity of the Boiler Plant and CEM system operations, utilizing Caldaia Controls expertise and qualifications is necessary to provide the overdue services and maintain uninterrupted facility operations.
6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as possible (including whether a notice was or will be publicized as required by RFO Part 5 and, if not, which exception under RFO Part 5 applies):
On 07/21/2026, this emergency procurement was authorized IAW RFO 12.201-1 and FAR 6.103-2 Unusual and compelling urgency. The Boiler Plant and CEMS PMI services requirement at the Greater Los Angeles VA Healthcare System was deemed an emergency due to overdue maintenance and inspection services caused by the current Contractor inability to perform services in accordance with the current contract 36C26226P0776 terms and conditions. There is not enough time to open this requirement, and through market research found, the identified vendor is qualified and capable of providing the Boiler Plant and CEMS PMI services for this emergency requirement. The vendor has developed a plan to ensure the Boiler Plant and CEM system is in full operation. On 07/21/2026, the vendor was verified through SAM.gov to ensure no active exclusions for pre-award.

Market research was used from within the last 12 months to determine an emergency award to the SDVOSB vendor for these services.
