About this file

This is a Single Source Justification for Simplified Acquisition Procedures under the Simplified Acquisition Threshold (SAT) for the Department of Veterans Affairs VISN 10, NIHCS Medical Center Marion Campus. The justification supports a $29,995 sole-source award to Shambaugh & Son, L.P. for acid bath treatment and repairs on three chillers at the Marion, Indiana facility.

The scope of work includes acid flushing of the condenser, rinsing with fresh water, removing heads to brush tubes in the condenser and heat exchange, replacing O-Rings in the 3-way valve, conducting leak tests, and evaluating/opening isolation valves. Shambaugh & Son was selected as the sole source due to their current role as the BMS Service Contract provider, local presence, and familiarity with the system. Market research was conducted through VetCert, DSBS, FPDS, sam.gov, NAC, and GSA, but due to urgency and potential impacts on patient care and Clean Air Act compliance, a sole source award was justified under FAR 13.106-1(b)(1)(i). The justification was signed by Contracting Officer Tiera Sims and digitally dated December 19, 2024.

VHAPG Part 813.106 Simplified Acquisition Procedures: Soliciting from a Single Source Attachment 1: Single Source Justification for SAP under the SAT

Last Updated: 02/01/22 Page 1 of 2

DEPARTMENT OF VETERANS AFFAIRS

Justification for Single Source Awards IAW FAR 13.106‐1 For

Over Micro‐Purchase Threshold but Not Exceeding the SAT ($250K)

Acquisition Plan Action ID:

1. Contracting Activity: Department of Veterans Affairs, VISN 10, NIHCS Medical Center Marion

Campus 1700 East 38th Street, Marion Indiana 46952 submits to Network Contracting Office (NCO) 10, located at 6100 Oak Tree Blvd., Suite 490, Independence, OH 44131 a request for an acid bath and chiller repair.

Transation ID: 610‐25‐1‐6091‐0012

2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount:

Three (3) chillers located at the Marion campus of the Northern Indiana Healthcare System 1700 East 38th Street, Marion Indiana 46952 require an acid flushing of the condenser. The contractor shall rinse system with fresh water after flushing, then remove heads to brush the tubes in the condenser and heat exchange. They shall also be responsible for putting the head back on the chiller, changing the O‐Rings in the 3‐way valve and conducting a leak test of the affected items.

Lastly, they will need to evaluate the system and open isolation valves.

Total contract value: $29,995.00

3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used:

The acid bath treatment for the chillers is critical due to blockage in the tubes. The tubes function as the circulatory system of the chiller, and clogged tubes can lead to significant issues. Chilled condenser water flows through these tubes, facilitating the transfer of heat extracted from the building between various water and refrigerant loops. The efficiency of the chilled water system is contingent upon effective heat transfer to cool the building without overburdening the chiller. If heat transfer is impeded due to the accumulation of scale, sediment, or slime, the chiller must exert more effort to move heat and compensate for inefficiencies caused by the dirty tubes. When fouling exceeds the manufacturers peramiters, the overall system experiences a reduction in capacity and increased energy consumption. Failure to address this will necessitate an unscheduled shutdown and physical cleaning of the chiller. We are also at risk of causing refrigerant leaks, which would further compound the issue and could cause long term damage which would be costly to the government.

Shambaugh & Son, L.P. is currently performing on the BMS Service Contract for this facility. They possess the familiarity with the system, & ability to perform these services with minimal downtime as they are established locally. Due to the arising urgency of this request, it would not be feasible to

Last Updated: 02/01/22 Page 2 of 2 pursue other sources, when we know Shambaugh has the capabilities to facilitate this request timely. Any further delays could negatively impact patient care as well as compliancy with the Clean Air Act enforced by Environmental Protection Agency (EPA).

4. Description of market research conducted and results or statement why it was not conducted:

Market research was conducted via VetCert, DSBS, FPDS, sam.gov, NAC, GSA, and internet search. VetCert return 1951 certified SDVOSB/VOSB contractors, 0 when using vendor name “Shambaugh”. DSBS return 35 profiles for SDVOSB contractors using NAICS 238220 in the state of Indiana. These services were not available via GSA or NAC contract. A NAICS code search on FPDS when narrowed to the state of Indiana returned 10+ results. SAM.gov revealed 10+ postings using NAICS & keyword search for Shambaugh. Shambaugh has been identified as the only source with familiarity with this equipment & system as they are currently performing on the BMS service contract for this facility. They are prepared to meet this urgent need in a timely manner, locally. The VA rule of two will not be achieved for this procurement. Intend sole source award IAW FAR 13.106‐ 1(b)(1)(i), Urgency.

5. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106‐1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.
