Section B: Description of the Supplies/Services Required
Purchase of 2000 tons of Bituminous Stoker Coal 1 ½”x ¼” and transfer by rail-car or truck to Malmstrom AFB Central Heating Plant.
Section C: Justification for Soliciting from a Single Source or Brand Name
10 U.S.C. 2304(c)(1), the property or services needed by the agency are available from only one responsible source or from a limited number of responsible sources and no other type of property or services will satisfy the needs of the agency, as implemented by FAR 6.302-1(a)(2), Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements, required by FAR 6.303-2(b)(4).
(2) When the supplies or services required by the agency are available from only one responsible source, or, for DoD, NASA, and the Coast Guard, from only one or a limited number of responsible sources, and no other type of supplies or services will satisfy agency requirements, full and open competition need not be provided for.
(ii) Supplies may be deemed to be available only from the original source in the case of a follow-on contract for the continued development or production of a major system or highly specialized equipment, including major components thereof, when it is likely that award to any other source would result in --
(A) Substantial duplication of cost to the Government that is not expected to be recovered through competition, or
(B) Unacceptable delays in fulfilling the agency's requirements. (See 10 U.S.C. 2304(d)(1)(B).
The recommended source is the only local provider of 1 1/2" Bituminous Stoker coal that meets the required characteristics and specifications for use with the Detroit Stoker Spreader Coal Feeders that are used on the High Temperature Hot Water Generators at Malmstroms Heat Plant. The coal has to meet the required specifications to insure compliance with the State and Federal Air Quality regulations (Malmstroms Air Quality Permit). Coal purchased that doesn't meet the required characteristics and specifications can cause a failure to comply with Malmstroms Air Quality Permit which would shutdown Plant operations and cause a risk of catastrophic damage to 70 infrastructure buildings and incurring fines for non compliance.
Section D: Efforts to Obtain Competition
In previous years, the 341st Contracting Squadron (CONS) has tried to solicit from multiple sources for this repeat requirement and have not found any vendors capable of meeting the requirements set forth by the customer. In Fiscal Year 2016, FA4626-16-P-0030, was awarded to another company as a "test run" in an attempt to increase competition, but the coal purchased under that contract did not satisfy the environmental requirements of 341st Civil Engineering Squadron (CES). At this present time, market research does not present any available competition endeavors available for this acquisition. Furthermore, the Government received no response with a capability statement in the response to

November 2018 FOR OFFICIAL USE ONLY Page 2 of 2 the Notice of Intent to Sole Source issued. Due to the historical lack of competition and Malmstrom's stringent specifications and location, Gebhart Post Plant & Sawmill is the only available source.
Section E: Steps to Preclude Future Single Source or Brand Name Awards
Based on the justification for single source and the need for the Bituminous Stoker Coal to meet the required specifications to ensure compliance with the State and Federal Air Quality regulations, there are no steps to include future single source awards unless the Air Force deems another system to be more advantageous and changes brands.
Section F: Contracting Officer's Determination
I have determined, in accordance with FAR 13.106-1(b)(1), that the circumstances of this contract action deem only a single source is reasonably available.
