Single Source Justification (Simplified Acquisition)

CONTROLLED UNCLASSIFIED INFORMATION

April 2021 CONTROLLED UNCLASSIFIED INFORMATION Page 1 of 2

Section A: General Contract Information

Is this a Bridge Action as defined in the AF Bridge Action Reduction Plan? Yes No

Contracting Activity: AFSC/PZIMC, Tinker AFB, OK

Project/Program Name: Clayton HEPA Vacuum Maintenance Services

Purchase Request / Local ID Number: FA813223Q0009

Estimated Contract Cost (including Options): $180,000.00

Section B: Description of the Supplies/Services Required

Provide preventive and remedial maintenance (PM and RM) services for the OC-ALC's Clayton HEPA vacuums IAW the procedures outlined in the OEM's technical manuals and the Performance Work Statement (PWS).

Section C: Justification for Soliciting from a Single Source or Brand Name

The HEPA Vacuums manufactured by Clayton Associates are a critical engineering control for ensuring personnel exposure to Chromium (VI) complies with OSHA expanded standards. Clayton Associates advises that they will not honor warranty claims on vacuums that have been repaired with unauthorized components. The vacuums were engineered with components designed to work together, and introduction of non-OEM filters or parts could result in damage. An award to any other source will create an unsafe environment due to the vacuums failing. This would immediately impact multiple platforms by potentially grounding aircraft. Due to the lack of non-OEM sources to perform the PM/RM service, the government does not expect that another source could become qualified in time to avoid unacceptable delays in meeting the current need. The development of organic maintenance procedures without the requisite data and/or technical manuals is impossible without extensive and costly reverse engineering. The Government does not have enough experience or historical data to estimate costs with any degree of specificity, but it is anticipated that developing maintenance capability for these vacuums, without any releasable data, would be a lengthy endeavor likely exceeding $3 million dollars, based on other reverse engineering projects within the Group.

Organic maintenance of the vacuums would also void any manufacturer warranty service, eliminating a value-added feature worth up to $30,000 per year in free service and parts. Further, funding has not been approved or budgeted for a reverse-engineering effort for these vacuums since the commercial source. It is not currently possible to draft adequate maintenance procedures without the technical data required, which would drive unacceptable delays in fulfilling OC-ALC's requirement, expected to be at a minimum of one year based on previous endeavors.

Section D: Efforts to Obtain Competition

Market research was conducted via Internet searches and discussion with Clayton Associates, who stated that they do not authorize or license any other vendors to perform maintenance on their equipment, and if any other vendor aside from Clayton were to perform any maintenance service on these systems, Clayton has the right to refuse service and will refuse any maintenance service requests for the affected systems at Tinker AFB.

An announcement will be posted on SAM.gov, informing the public of this sole source award. Interested parties may respond.

Section E: Steps to Preclude Future Single Source or Brand Name Awards

An announcement will be posted on SAM.gov, informing the public of this sole source award. Interested parties may respond. The Government will continue to monitor the marketplace for source development and continue discussions
