5.2 Specific Characteristics of the Unique or Highly Specialized Item or Service:

6. Check all applicable statements:

The material or service must be compatible in all aspects (form, fit, function) with existing systems presently installed. The new product(s) / service(s) must coordinate, connect, or interface with existing systems.

A patent, copyright, proprietary data, or licensing agreement limits competition.

These are "direct replacement" parts/components for existing equipment.

The Oxford Instruments' 100 ICP180 (Etcher) is used for several courses, student thesis, and research work. The contract is for annual service and maintenance, which is required to keep the instrument operational and to replace any broken parts or address any performance issues with the following technical requirements:

- Services performed by the manufacturer-certified technician

- All parts used are provided/approved by the manufacturer

- Telephone support available for the duration of the service contract to include questions including performance issues, troubleshooting and recipes.

6.1 Compatibility Statement:

6.2 Copyright / Proprietary Data / Licensing Agreement Statement:

Oxford Instruments is the manufacturer and is able to maintain and warrant the maintenance of the equipment. The manufacturer is equipped with access to appropriate replacement parts and components for this instrument. If non manufacturer-supplied parts are used, it will degrade system performance.

While there may be other vendors that can provide parts and components developed by Oxford Instruments, the third parties will not be able to provide the required proper repair/maintenance services on the 100 ICP180.

Oxford Instruments declared that it is currently the only service provided in the United States for the 100 ICP180. It does not currently train, authorize, or support third party service organizations in repair/maintenance of Oxford Instruments' 100 ICP180. Therefore, the repair/maintenance services can be provided by the manufacturer only.

See sole source declaration letter from Oxford Instruments dated 7/8/2020.

Although some components may be available through common distributors, all schematics, manufactured assemblies, parts/spares and technical knowledge are proprietary and not available/reproducible via third party service providers.

7. Brand Name (if applicable, detail why the procurement is restricted to a specific brand name manufacturer):

8. Additional information supporting a sole source acquisition:

This is a renewal action of the current contract N62271-15-M-1115 awarded to Oxford Instruments based on the sole source justification. The contract is expiring 9/24/2020.
