About this file

This document is a justification for a sole source procurement submitted by the Centers for Disease Control and Prevention to acquire the Qiagen EZ2 Extraction Platform. The CDC's Influenza Division requires the Qiagen EZ2 Dx extraction system to evaluate the performance of its FDA-cleared and approved in vitro diagnostic assays for influenza and SARS-CoV-2 on samples extracted using the instrument. Qiagen is the sole producer of the EZ2 Dx extraction platform, and it is intended to replace Qiagen's EZ1 extractor which is being discontinued. No other extraction platforms were considered because the CDC needs to specifically test its assays on samples extracted by the EZ2 Dx system. The estimated cost of the sole source procurement is not provided. The justification and certifications from the CDC program office and contracting office demonstrate the non-competitive procurement is reasonable and necessary.

☒ In accordance with FAR 13.106-1(b)(1), “only one source [is] reasonably available” which states that, “For purchases not exceeding the simplified acquisition threshold. (i) Contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization). (ii) Where a single source is identified to provide a portion of a purchase because that portion of the purchase specifies a particular brand-name item, the documentation in paragraph (b)(1)(i) of this section only applies to the portion of the purchase requiring brand-name item. The documentation should state it is covering only the portion of the acquisition which is brand- name.”

☐ Urgency ☐ Only One Source ☐ Logical Follow Up ☐ Brand name required

2. Other facts supporting sole source procurement:

a. What can this product/service do that other products/services cannot do?

The Qiagen EZ2 Dx extraction system is a benchtop instrument for extracting nucleic acids from specimens and it is cleared as an in vitro diagnostic (IVD) instrument. The Qiagen EZ2 Dx extraction system is the replacement for the Qiagen EZ1 extraction system, which is an IVD extractor that is being sunset by Qiagen that is currently approved for use with CDC Influenza and SARS-CoV-2 FDA approved and FDA cleared assays. The influenza division is acquiring the EZ2 Dx extraction platform to evaluate performance of our FDA cleared and FDA approved in vitro diagnostic assays for Influenza and SARS-CoV2 on samples that have been extracted on the EZ2 to determine if the EZ2 can be used with our assays. Qiagen is the only company that produces the EZ2 Dx extraction platform.

b. What other products/services were considered and why did they not meet the need?

Rev. 5/14/19

We are specifically purchasing the Qiagen EZ2 Dx extraction system to evaluate performance of our FDA cleared and FDA approved in vitro diagnostic assays for influenza and SARS-CoV-2 on samples extracted with this instrument. Qiagen is the only company that produces the EZ2 Dx extraction platform.
