About this file

This is a Sole Source Justification document for a simplified acquisition of commercial items under Federal Acquisition Regulation (FAR) 12.102(b). The Department of Veterans Affairs, Network Contracting Office 15, is procuring 14 AvaSure software licenses and support (model AVA-E-0104-1Y-R) on a firm fixed-price basis for Harry S. Truman Memorial Veterans Hospital in Columbia, Missouri. The acquisition ID is 36C255-26-AP-2013, with Purchase Request Number 589-26-3-5601-0179, effective December 30, 2025 (Revision 02).

The AvaSure TeleSitter Solution provides continuous remote video monitoring of multiple patients from a centralized station, enabling trained technicians to intervene via two-way audio or in-person to prevent falls and adverse events. Competition is restricted under the "Only One Responsible Source" authority because the proprietary nature of the currently installed equipment limits providers to the OEM and its certified SDVOSB partner, Sierra7 (an FSS contract holder). This is a follow-on contract to replace the expired contract GS-35F-0834R 36C25522F0032, originally competitively procured in September 2023. The justification notes that recompeting would result in substantial duplication of costs to the government. Fair and reasonable pricing will be determined through comparison to an Independent Government Cost Estimate based on historical pricing from similar contracts. The solicitation will be publicized on SAM.gov as unrestricted on the open market. The requirement was certified by Jessica Furlong (Executive Assistant, Patient Care Services, Columbia VAMC) and approved by Contracting Officer Veronica (Betty) Flores and Supervisory Contract Specialist Randall D. Combs (Division Chief, Division II, NCO 15).

Simplified Acquisition Procedures for Certain Commercial Items

Effective Date: 12/30/2025 Page 1 of 4 Revision: 02 Acquisition ID#: 36C255-26-AP-2013

DEPARTMENT OF VETERANS AFFAIRS

SOLE SOURCE JUSTIFICATION UNDER SIMPLIFIED PROCEDURES FOR CERTAIN COMMERCIAL

ITEMS IN ACCORDANCE WITH REVOLUTIONARY FAR OVERHAUL 12.102(b)

Acquisition Plan Action ID: 36C255-26-AP-2013

1. Contracting Activity: Department of Veterans Affairs, Network Contracting Office 15, located at

3450 S. 4th Street Trafficway, Leavenworth, KS 66408, in support of VISN 15 VA Health Care System at Harry S. Truman Memorial Veterans Hospital, 800 Hospital Drive, Columbia, MO 65201-5275.

Purchase Request Number: 589-26-3-5601-0179

2. Nature and/or Description of the Action Being Processed: This procurement is a firm firm-fixed-price Brand Name Justification for AvaSure Software Licenses, in accordance with RFO 12.102(b) Simplified Procedures for Certain Commercial Item.

3. Description of Supplies/Services Required to Meet the Agency’s Needs:

This requirement is for the AvaSure TeleSitter Solution, which provides continuous remote video monitoring of multiple patients from a centralized station, allowing trained technicians to intervene via two-way audio or in person to prevent falls and other adverse events. This justification is to procure 14 AvaSure software licenses and support, AVA-E-0104-1Y-R, for the currently installed AvaSure System utilized throughout Columia VAMC.

4. Statutory Authority Permitting Restricted Competition:

RFO 12.102(b) Simplified Procedures for Certain Commercial Items. The statutory authority for applying the Simplified Procedures for Commercial Items of RFO 12.102(b)is 41 U.S.C. § 1901 and is implemented by RFO 12.102(b) for restricting competition on this procurement. Competition is restricted on this procurement for the reason below:

( X ) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements

( ) Unusual and Compelling Urgency ( ) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert

Services ( ) International Agreement ( ) Authorized or Required by Statute ( ) National Security ( ) Public Interest

Effective Date: 12/30/2025 Page 2 of 4

5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): The highly specialized service of this requirement inherently limits the number of contractors that can provide this service, due to the proprietary nature of the currently installed equipment. Only the OEM and its only certified SDVOSB, Sierra7 an FSS contract holder, are the only authorized providers that can provide the software licensing and support required to maintain this proprietary equipment and keep it fully operational.

Due to the existing TeleSitter equipment installed throughout the Columbia VA Medical Center, and the proprietary software required for its operation, no other vendor can provide the necessary services or licenses for this procurement. Additionally, any attempt by an unauthorized vendor to perform these services would risk system malfunction and hinder patient care.

This requirement represents a follow-on contract to replace the expired contract GS-35F-0834R 36C25522F0032, for continued support of a highly specialized system that was competitively procured in September 2023. No other contractoSr can provide software licenses and support for this technology. Recompeting the entire TeleSitter requirement would result in substantial duplication of cost to the Government that could not reasonably be expected to be recovered through competition.

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: A Sources Sought synopsis was not issued, due to the sole source letter received from AvaSure indicating that only one other firm could provide this requirement.

Further more, only a limited number of responsible sources, since it is this survey of the market place that confirms our assumptions regarding the capability of industry to meet our needs.

This solicitation will be publicized on SAM.gov as Unrestricted on the Open Market.

7. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable: A fair and reasonable price determination will be made by comparison to the Independent Government Cost Estimate that was formulated by using market research of historical pricing from same or similar scope contracts that have been determined fair and reasonable.

8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons

Market Research Was Not Conducted:

Effective Date: 12/30/2025 Page 3 of 4

In accordance with FAR 25.103(e), this requirement is for an IT commercial product and is therefore exempt from the restrictions outlined in FAR Part 25.

9. Any Other Facts Supporting the Use of Other than Full and Open Competition: N/A

10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition:

11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required:

There will be continued surveillance to monitor the industry for new entrances to the market place.

Furthermore, as the equipment nears the end of its life expectancy, the equipment team will reevaluate their facility's needs with the current industry capabilities and the VA's long term strategic planning to maximize competition to the extent practical.

12. Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
