Sole Source Justification for Revvity Image Artist Software Maintenance Agreement

This document is a Sole Source Justification for Acquisitions Between $25K–$250K submitted by the National Institutes of Health (NIH) under the National Cancer Institute (NCI). The sponsoring organization is the Laboratory of Receptor Biology and Gene Expression (LRBGE) High-Throughput Imaging Facility (HTiF). The acquisition covers renewal of 15 Revvity Image Artist user licenses and software maintenance agreements for the period August 7, 2026, through August 6, 2027. Image Artist is a next-generation image analysis and management platform used for high-content screening and cell imaging data processing, currently deployed on NCI Cloud One (AWS). The requirement is classified as Information Technology (IT) under a firm-fixed-price contract type, designated as a new requirement.

The contracting officer determined that only one source—Revvity Signals Software, Inc. (John Giese, 940 Winter Street, Waltham, MA 02451)—is reasonably available because Image Artist is proprietary software developed and copyright-protected exclusively by Revvity, with no authorized resellers or alternative sources capable of providing the required licenses and technical support. Market research confirmed no competing platforms can support the Government's existing installed environment while maintaining compatibility with established image-analysis workflows without significant additional costs and operational disruption. The anticipated cost for the fifteen user licenses is redacted but supported by comparison to prior-year pricing, with a modest year-over-year increase of approximately 5.3%, below the reported Software-as-a-Service market inflation rate. The acquisition is conducted under FAR 13.106-1(b)(1)(i) for single-source procurement below the simplified acquisition threshold due to exclusive licensing agreements and brand-name requirements. No other sources expressed written interest in the acquisition.
