About this file

This is a representation and self-certification form for the Indian Health Service's Buy Indian Act program, specifically for Indian Economic Enterprises (IEEs).

The form requires offerors to self-certify their status as an Indian Economic Enterprise with Indian Ownership under the authority of 25 U.S.C. 47 (Buy Indian Act) in response to Sources Sought Notices, Requests for Information (RFI), or Solicitations. Eligible enterprises must maintain their IEE status at three critical junctures: at the time of offer submission, at contract award, and throughout the full contract performance period. Any loss of eligibility during these periods requires immediate written notification to the Contracting Officer. The form requires identification of the Federally Recognized Tribal Entity, the business name, the 51% owner of the IEE firm, and the Unique Entity Identifier (UEI) number. The offeror must indicate whether it meets or does not meet the IEE definition by checking the appropriate box and providing a certifying signature with printed name. The document emphasizes that Contracting Officers may request documentation of eligibility before awarding set-aside or sole source contracts, and that awards may be subject to protest if the offeror's eligibility is questioned. False or misleading information constitutes a violation of law under 18 U.S.C. 1001, while false claims during contract performance are subject to penalties under 31 U.S.C. 3729-3731 and 18 U.S.C. 287. Successful offerors must also be registered with the System of Award Management (SAM).
