About this file
This is an Indian Economic Enterprise Representation Form required by the Indian Health Service (IHS) under the Buy Indian Act for federal contract opportunities.
The form serves as a self-certification document that offerors must complete to demonstrate they meet the definition of an "Indian Economic Enterprise" (IEE) with Indian Ownership under 25 U.S.C. 47 and EHSAR 326.601. The form applies to Sources Sought Notices, Requests for Information (RFI), and Solicitations issued by IHS. Offerors must certify their IEE status at three critical junctures: when submitting an offer, at the time of contract award, and throughout the entire contract performance period. Any change in eligibility status during these periods requires immediate written notification to the Contracting Officer. The form requires completion of specific fields including the solicitation number, project title, date, name of the Federally Recognized Tribal Entity, name of the 51% owner of the IEE firm, business name, Unique Entity Identifier (UEI) number, and certifying signature with printed name. False or misleading information constitutes a violation under 18 U.S.C. 1001, with additional penalties for false claims during contract performance under 31 U.S.C. 3729-3731 and 18 U.S.C. 287. Successful offerors must also maintain registration with the System of Award Management (SAM), and awards may be subject to protest regarding offeror eligibility.
