About this file
This document is a Sole Source Justification under Simplified Procedures for Certain Commercial Items from the United States Department of Agriculture (USDA) Animal and Plant Health Inspection Service (APHIS). The document seeks to directly contract helicopter mechanic services with Mac-V Aviation (MVA) for a specially modified Hughes OH-6A helicopter used in Brown Treesnake (BTS) control operations on Guam. The contract will be an indefinite delivery, indefinite quantity (IDIQ) arrangement with a five-year period of performance, consisting of five one-year ordering periods, and a contract ceiling of $2,000,000.
The justification highlights MVA's unique qualifications, specifically their prior work with Applied Design Corporation (ADC) on a proprietary, patent-pending BTS bait dispensing system. The helicopter mechanic will provide preflight and annual mechanical inspections, scheduled maintenance, and on-site support during aerial operations. Market research conducted found no alternative vendors with experience working on the Automatic Delivery System (ADS). The daily mechanic rate is within industry standards of $1,000-$2,000 per day, and the contract will cover travel and on-site days for BTS treatment regimens, with the next treatment planned for August 2025.

United States Department of Agriculture Sole Source (Including Brand Name) Justification under
Simplified Procedures for Certain Commercial Items (FAR 13.5) Control No. SS1155104
1. Identification of the agency and the contracting activity.
1a. Requesting Activity Agency:
USDA APHIS WS
Guam / Western Pacific Theater 233 Pangelinan Way, Barrigada, Guam 96913
1b. Contracting Activity:
USDA APHIS MRPBS
250 Marquette Ave, Ste 410
Minneapolis, MN 55401
2. The nature and/or description of the action being approved.
Helicopter mechanic services by Mac-V Aviation (MVA) are being sought for an agency owned Hughes OH-6A that has been modified to accept the Automatic Delivery System (ADS). Services will be contracted as indefinite delivery, indefinite quantity (IDIQ) with a five-year period of performance comprised of five one-year ordering periods.
The ADS is a proprietary, patent pending Brown Treesnake (BTS) bait dispensing system developed by Applied Design Corporation (ADC) for BTS control on Guam. MVA has been a subcontractor of ADC for past contracts; however, it was determined that it would result in cost savings to the government to directly contract with MVA. This procurement provides for continued use of MVA for helicopter mechanic services and assistance with technical problem solving on the ADS during operations.
3. A description of the supplies or services required to meet the agency’s needs (including the estimated value).
The next BTS treatment regimen not covered by a current contract is planned for August 2025. Additional treatment regimens will be required in an unknown quantity on yet to be determined future dates over the next five years.
MVA provided helicopter mechanic will provide preflight and annual mechanical inspections, scheduled maintenance (anti-collision lights and engine drive shaft replacement) and minor repairs as needed of an agency owned Hughes OH-6A that has had the cargo bay modified to accept an ADS. The mechanic will be on-site with the rotorcraft through the duration of the aerial operations to provide mechanical services to helicopter and ADS if required and act as ground marshal.
An IDIQ helicopter mechanic services contract will be required to accomplish all required operational support and maintenance tasks of an agency-owned OH-6A required for treatment regimes. Paid days include the days of travel and days on Guam but does not include per diem or lodging, which is paid separately based on the FTR rates. Contract ceiling set at $2,000,000 for the five-year period of performance.
4. The statutory authority permitting other than full and open competition.
41 U.S.C § 1901 - Simplified Acquisition Procedures up to $7.5 million, as authorized by FAR 13.500(a) and implemented by FAR 13.501(a).
5. Supporting rationale demonstrating the unique qualifications of the proposed contractor or the nature of the action requiring the use of the authority.
As mentioned above, these services involve a proprietary, patent pending system developed by ADC. The Applied Design engineering team has detailed knowledge of the highly complex requirements and nuances of the equipment. The MVA helicopter mechanic has worked with the Applied Design team on modifications to the agency owned Hughes OH-6A cargo bay and subsequent on-site modifications to the ADS itself to facilitate better performance within the agency owned helicopter. This knowledge and expertise from the MVA mechanic of the agency owned Hughes OH- 6A modifications and the proprietary bait delivery system cannot be readily and rapidly conveyed to other potential contractors.
6. A description of efforts made to ensure offers are solicited from as many potential sources as is practicable.
Notice of intent to sole source posted on sam.gov
7. A determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.
MVA has provided detailed technical overview and cost breakdown for previous baiting operations for APHIS. During the multi-year relationship with MVA costs have been found to be fair and reasonable. Daily mechanic rate for the field service contract is within the industry standards ($1,000-$2,000/day).
8. A description of the market research conducted and the results or a statement of the reason Market Research was not conducted.
Market research conducted to indentify if other potential vendors have experience or exposure working on the ADS. No additional vendors were identified.
9. Any other facts supporting the use of other than full and open competition.
The contemplated procurement is for technical non-personal services in connection with the assembly, installation, or servicing of equipment of a highly technical or specialized nature.
10. A listing of the sources, if any, that expressed a written interest in the acquisition.
N/A
11. A statement of actions, if any, the agency may take to remove or overcome any barriers to competition if subsequent acquisitions are anticipated.
N/A
