About this file
This document is a notice for an intended single source procurement published by the Florida Department of Agriculture and Consumer Services. The agency seeks to purchase an Agilent 7010 EI/MS/MS mass spectrometer for $274,185.47 to support the Division of Food Safety regulatory program and the USDA Pesticide Data Program. The justification for the single source purchase cites the need for compatibility with the agency's existing Agilent Mass Hunter software, methods, and reporting, as well as the unique self-cleaning feature of the Agilent ion source. The notice was posted on January 6, 2023, and information from prospective vendors is requested by January 27, 2023.
The estimated total value of the purchase is up to $300,000. This is not a request for bid or proposal, but rather the statutory advertisement of the intended single source procurement. The Division of Food Safety, Bureau of Laboratories has provided the justification for the single source selection of Agilent Technologies as the sole source for the required equipment.

Justification for single source acquisition (what is necessary and unique about the product, service or source; steps taken to confirm unavailability of competition, as appropriate):
The following specifications are unique to the Agilent 7010 EI/MS/MS instrument and no other manufacturer can meet the specifications:
1. The system and associated data acquisition and control software must be compatible with customer’s existing methods created using Agilent Mass Hunter software, to include acquisition parameters, processing methods, and reports. This platform will be one of three systems generating data for the State and PDP programs. It is critical for employee training and sample workload demands that all systems share similar methods, reports, and acquisition/control software.
2. The mass spectrometer ion source must have a self-cleaning feature. The only other option on the market is manually cleaning the mass spectrometer ion source.
Manually cleaning the ion source is unacceptable because it requires instrument downtime preventing the analysis of samples.
Only Agilent Technologies can provide the EI/MS/MS that meets the compatibility specifications as provided above. Raymond Allum, to the best of his knowledge, knows no other company that has a self-cleaning source. The Division of Food Safety, Bureau of Laboratories request that this purchase be carried out on a single source basis. A written price quote is attached for the instrument.
Approved By (names & titles, as appropriate, e.g., requestor, requestor management, information systems, budget, purchasing):
Dr. Matthew Curran, Director, Division of Food Safety Mike Thompson, Division of Food Safety Channcen Bell, Purchasing Specialist Joey B. Hicks, Director, Division of Administration
Prospective vendors are requested to provide information regarding their ability to supply the commodities or contractual services described. If it is determined in writing by the agency, after reviewing any information received from prospective vendors, that the commodities or contractual services are available only from a single source, the agency shall provide notice of its intended decision to enter a single-source purchase contract in the manner specified in Rule 60A- 1.045, Florida Administrative Code, and section 120.57(3), F.S.
