About this file

This is an Indian Firm Representation Form required by the Indian Health Service (IHS) Division of Acquisition Policy for the solicitation IHS-SS-26-1520227 related to HVAC inspections at Fort Yates and YRTC, dated 04/20/2026.

The form requires offerors to self-certify their status as an "Indian Firm" with "Indian Ownership" in accordance with 25 U.S.C. 47 (Buy Indian Act) and HHSAR regulations 326.602 and 326.603. Offerors must meet the Indian Firm definition at three critical junctures: at the time of offer submission, at contract award, and throughout the full contract performance period. Any change in eligibility status during these periods requires immediate written notification to the Contracting Officer. Contracting Officers may request documentation of eligibility before awarding set-aside or sole source contracts, and awards are subject to protest if the successful offeror's eligibility is questioned. Successful offerors must be registered with Dun & Bradstreet (D&B) and the System of Award Management (SAM). The form includes a representation section where offerors indicate whether they do or do not meet the Indian Firm definition, with required signature blocks for certifying signature, business name, SAM UEI number, and printed name. False or misleading information submitted in connection with a Buy Indian Act award set-aside violates 18 U.S.C. 1001, and false claims during contract performance are subject to penalties under 31 U.S.C. 3729-3731 and 18 U.S.C. 287.
