PART I - THE SCHEDULE

SECTION B

SUPPLIES OR SERVICES AND PRICES/COSTS

This RFP is for a single Indefinite Delivery/Requirements Contract for the supplies specified herein. The resultant contract will have one (1) 12‐month basic ordering period, and four (4) twelve‐month ordering periods.

Quantity: The quantities represented in the Schedule represent the Government's Best Estimated

Quantities (BEQs) based on actual history and projected requirements. These BEQs do not represent a minimum or a maximum quantity. Failure of the Government to order the BEQ shall not entitle the contractor to an equitable adjustment in price under the contract.

Ordering Periods/BEQs are as follows:

Basic Ordering Period (Contract award through 12 months): 52 Each

Ordering Period 1 (13 months through 24 months): 55 each

Ordering Period 2 (25 months through 36 months): 49 each

Ordering Period 3 (37 months through 48 months): 52 each

Ordering Period 4 (49 months through 60 months): 52 each

There are specific contractor fill‐ins required in this solicitation. Please review carefully and complete all required fill‐ins.

Note 1: All clauses/provisions in this solicitation and resultant contract are important and the offeror shall ensure that it has reviewed and understands each one. Signing the face page of the solicitation acknowledges review and agreement of all provisions contained within.

Note 2: With your proposal, please provide a Cost Model in Excel format with working formulas. The cost model shall provide the information required for a full analysis by the USG of the costs proposed for this effort.

Note 3: In accordance with DFARS 252.215‐7009, please fill out the attached Proposal Adequacy

Checklist and include it with your proposal.

Note 4: For the purposes of FAR 52.216‐22, the contractor shall not be required to make any deliveries under the contract after completion of all orders.

Note 5: Items delivered hereunder shall be packaged in accordance with AFMC Form 158 attached to each delivery order issued hereunder.

Note 6: Transportation of items delivered hereunder shall be in accordance with DD Form 1653 attached to each delivery order issued hereunder.

Note 7: A subcontracting plan may be required and is requested to be included in proposal submission.

(a) Definitions. As used in this clause—

(a) Invoice payments—

(5) Computing penalty amount. The Government will compute the interest penalty in accordance with the Office of Management and Budget prompt payment regulations at 5 CFR part 1315.

(i) For the sole purpose of computing an interest penalty that might be due the Contractor, Government acceptance is deemed to occur constructively on the 7th day (unless otherwise specified in this contract) after the Contractor delivers the supplies or performs the services in accordance with the terms and conditions of the contract, unless there is a disagreement over quantity, quality, or Contractor compliance with a contract provision. (a) Definitions. As used in this clause—

(1) “Contract financing payment” and “invoice payment” have the meanings given in section 32.001 of the Federal Acquisition Regulation.

(2) “Electronic form” means any automated system that transmits information electronically from the initiating system to all affected systems. Facsimile, e‐mail, and scanned documents are not acceptable electronic forms for submission of payment requests. However, scanned documents are acceptable when they are part of a submission of a payment request made using Wide Area WorkFlow (WAWF) or another electronic form authorized by the Contracting Officer.

(3) “Payment request” means any request for contract financing payment or invoice payment submitted by the Contractor under this contract.

(b) Except as provided in paragraph (c) of this clause, the Contractor shall submit payment requests and receiving reports using WAWF, in one of the following electronic formats that WAWF accepts: Electronic Data Interchange, Secure File Transfer Protocol, or World Wide Web input. Information regarding WAWF is available on the Internet at https://wawf.eb.mil/ .

(c) The Contractor may submit a payment request and receiving report using other than WAWF only when—

(1) The Contracting Officer authorizes use of another electronic form. With such an authorization, the Contractor and the Contracting Officer shall agree to a plan, which shall include a timeline, specifying when the Contractor will transfer to WAWF;

(2) DoD is unable to receive a payment request or provide acceptance in electronic form;

(3) The Contracting Officer administering the contract for payment has determined, in writing, that electronic submission would be unduly burdensome to the Contractor. In such cases, the Contractor shall include a copy of the Contracting Officer’s determination with each request for payment; or

(4) DoD makes a payment for commercial transportation services provided under a Government rate tender or a contract for transportation services using a DoD‐approved electronic third party payment system or other exempted vendor payment/invoicing system (e.g., PowerTrack, Transportation Financial Management System, and Cargo and Billing System).

(d) The Contractor shall submit any non‐electronic payment requests using the method or methods specified in Section G of the contract.

(e) In addition to the requirements of this clause, the Contractor shall meet the requirements of the appropriate payment clauses in this contract when submitting payment requests.

(b) Prohibition. Section 1656 of the National Defense Authorization Act for Fiscal Year 2018 (Pub. L. 115–91) prohibits agencies from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service to carry out covered missions that uses covered defense telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system.
