IV. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN COMPETITION
10 USC 2304(c)(1), as implemented by FAR 6.302-1, Only One or a Limited Number of Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.
V. DEMONSTRATION THAT THE CONTRACTOR’S UNIQUE QUALIFICATIONS OR NATURE OF
THE ACQUISITION REQUIRES THE USE OF THE AUTHORITY CITED ABOVE
The AMC/AMSC code for this requirement is 1/C. This part requires engineering source approval by the design control activity in order to maintain the quality of the part. Existing unique design capability, engineering skills, and manufacturing knowledge by the qualified source(s) require acquisition of the part from the approved source(s). The approved source(s) retain data rights, manufacturing knowledge, or technical data that are not economically available to the Government, and the data or knowledge is essential to maintaining the quality of the part. An alternate source must qualify in accordance with the design control activity's Source Qualification Statement (SQS), as approved by the cognizant Government system engineering activity and or the Original Equipment Manufacturer (OEM). The qualification procedures must be approved by the Government engineering activity having jurisdiction over the part in the intended application.
VI. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE SOLICITED FROM AS
MANY POTENTIAL SOURCES AS DEEMED PRACTICABLE
This requirement will be synopsized on Federal Business Opportunities (FedBizOpps) as required by FAR
5.201. If other sources express interest as a result of this synopsis or other action, they will be listed in the official contract file. The SQS will be made available to all potential sources who express interest in becoming a qualified source, consideration will be given to those sources provided they become qualified IAW the applicable SQS as determined by the systems engineer prior to contract award.
VII. DETERMINATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED COST TO
THE GOVERNMENT WILL BE FAIR AND REASONABLE
The overall cost of this acquisition will be fair and reasonable to the Government. In accordance with FAR 15.404, it is anticipated that negotiations will be conducted using information other than cost and pricing data from the contractor. Thorough price analysis will be conducted using available information and approved pricing techniques. This will support the contracting office in making a determination that the price paid is fair and reasonable to the Government.
VIII. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE RESULTS, OR
STATEMENT OF THE REASONS MARKET RESEARCH WAS NOT CONDUCTED
As described in Section VI above, market research, IAW FAR Part 10, was conducted by synopsis of the proposed acquisition, advising industry of the pending acquisition and soliciting inquiries from interested parties.
Recommend full and open competition acquisition strategy, with the understanding that potential suppliers must satisfy engineering configuration control authority requirements established in the Pre- Qualification Statement and the manufacturer must possess an FFL for this contract. The Pre- Qualification Requirements, along with drawings, was posted by the Small Business Office, on 16 October 2014 for a sources sought action, to find potentially interested suppliers in this buy. This resulted in no responses to the posting from any vendor. Recommend a firm, fixed price contract to include a basic year purchase with four one year ordering periods. No existing contract vehicles exist that will satisfy this requirement. Contract award to a company other than Thomas Instruments Inc. will require a First Article Test due to not having produced the item within the last 48 months.
Based on the market research conducted, there is a high level of confidence that there are no additional sources currently capable of satisfying the agency’s need nor are there any other commercial or non-developmental items which could be utilized or which could be modified to meet the Governments needs.
IX. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND OPEN
COMPETITION
None
X. LIST OF SOURCES, IF ANY, THAT EXPRESSED INTEREST IN THE ACQUISITION
See Section VI above.
XI. A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO REMOVE OR
OVERCOME ANY BARRIERS TO COMPETITION BEFORE MAKING SUBSEQUENT
ACQUISITIONS FOR THE SUPPLIES
Qualification requirements are available through the solicitation or upon request to any prospective offeror(s) interested in becoming a qualified source. The System Engineer will assist interested concerns in meeting the standards specified for qualification IAW the SQS.
