I. CONTRACTING ACTIVITY
This Justification and Approval to request authority for Other Than Full and Open Competition supports requirements generated for the Air Force Sustainment Center (AFSC), 638 Supply
Chain Management Group (SCMG), 411 th
Supply Chain Management Squadron (SCMS) /
GULA. The contracting authority for this requirement is the Defense Logistics Agency (DLA)
Avionics at Warner Robins., The purchase request number supporting this contracting action is
FD2060-15-00030.
II. NATURE AND/OR DESCRIPTION OF THE ACTION BEING PROCESSED

ARO, total delivery of 20 ea.
AMC/AMSC: 3/P has been assigned, AMC 3: Acquire, for the second or subsequent time, directly from the actual manufacturer. AMSC P: The rights to use the data needed to purchase this part from additional source(s) are not owned by the Government and cannot be purchased, developed, or otherwise obtained. It is uneconomical to reverse engineer this part.
The main rotor blade is the combination of a rotary wing and a control system that generates the aerodynamic lift force that supports the weight of the helicopter, and the thrust that counteracts aerodynamic drag in forward flight. Each main rotor is mounted on a vertical mast over the top of the helicopter, as opposed to a helicopter tail rotor, which connects through a combination of drive shaft(s) and gearboxes along the tail boom. A helicopter's rotor is generally made of two or more rotor blades. The blade pitch is typically controlled by a swashplate connected to the helicopter flight controls.
The main rotor blades were designed by Bell Helicopter Textron exclusively for use on both the
UH-1N and TH-1H helicopters. The main rotor contains two rotor blades which provide lift and directional control of the helicopter. The main rotor blade is designated a Critical Safety Item
(CSI).
IV. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN
COMPETITION
10 USC 2304(c)(1), as implemented by FAR 6.302-1, Only One Responsible Source and No
Other Supplies or Services Will Satisfy Agency Requirements.
V. DEMONSTRATION THAT THE CONTRACTOR’S UNIQUE QUALIFICATIONS
OR NATURE OF THE ACQUISITION REQUIRES THE USE OF THE AUTHORITY
CITED ABOVE
The agency's minimum needs can only be satisfied by the unique supplies or services available from only the cited source(s), which possesses the unique capabilities demonstrated as follows:
The Main Rotor Blade is an Aviation Critical Safety Item (CSI) and a Bell Helicopter Textron
Inc. designated Critical Part. The main rotor blade is a metal bonded assembly consisting of four major sections: main spar, honeycomb core, trailing edge extrusion, and a nose block extrusion. Fiberglass straps are bonded inside the upper and lower spar surfaces to act as redundant structure and to provide load paths to carry primary loads should the spar be damaged or develop fatigue cracks. Skins, stabilized by the honeycomb core, are bonded to the major section by adhesive applied under heat and pressure. Reinforcing doublers, grip plates, and drag plates are bonded to the blade butt end. Stainless steel strips cover leading edges for resistance to abrasion. A trim tab on the trailing edge and a fitting on the blade tip are also provided. The quality of the blade shall conform to Bell Helicopter Textron Inc. Design Process Specification
No. 77. The main rotor blades have critical characteristics which, if not conforming to the required design, could cause failure of the part and result in loss of the aircraft and possible loss of life. The main rotor blade supports the UH-1N and TH-1H platforms in support of the Special
Operation Special Forces (SOF)/Search and Rescue Personnel Recovery missions. These blades were designed by Bell Helicopter Textron (BHT) Cage Code: 97499, exclusively for use on UH-
1N and TH-1H helicopters. On 20 Oct 2014, 411 SCMS sent via e-mail request to buy the data and data rights from Bell Helicopter Textron Inc. On 20 Oct 2014 Bell Helicopter Textron Inc.
via e-mail responded that they will not sell the data or the data rights to the Government.

The program and service life of the
UH-1N and TH-1H helicopters is expected to be active through 2040
The USAF’s minimum needs can only be satisfied by the unique supplies or services available from Bell Helicopter Textron, Cage 97499.
VI. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE
SOLICITED FROM AS MANY POTENTIAL SOURCES AS DEEMED PRACTICABLE
This requirement will be synopsized on the Federal Business Opportunities (FedBizOpps) web page as required by FAR 5.201. It is anticipated that sources having an interest in subcontracting may be identified through synopsis. Although the Government does not own data to support acquisition of the main rotor blade from any other source, any source who responds to the
Government as a result of this synopsis will be identified to the prime contractor as a potential for subcontracting possibilities.
VII. DETERMINATION BY THE CONTRACTING OFFICER THAT THE
ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE
The overall cost of this acquisition will be fair and reasonable to the Government. In accordance with FAR 15.403-4, the contractor will be required to provide certified cost and pricing data to be used in supporting the Government’s evaluation of the proposed cost. The proposed skill mix of labor, labor hours, types and quantities of material, other direct costs, and direct and indirect rates will be negotiated by the Government based on recommendations from the Defense
Contract Audit Agency (DCAA) and expert technical personnel supporting the program. The contract price will be negotiated in accordance with the procedures in FAR Part 15 ensuring the ultimate cost to the Government is fair and reasonable.

Market research was conducted on 29 Aug 2014, pursuant to FAR 10.001 and 10.002. Market research tools were utilized by the government program management/engineering team. The team members conducted internet searches, trade journals and the Haystack Database which details the history of design for the item. Also, an examination of the available technical data was conducted. A Federal Logistic Information search was performed to determine if the item was available from a different vendor. An internet search was also conducted, but revealed no other potential buy sources. Based on available information and engineering knowledge of the item and the aerospace industry, the only viable source for the purchase of this part is Bell
Helicopter Textron Inc. CAGE 97499. No small business and no small disadvantage opportunities can be met concerning this acquisition.
IX. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND
OPEN COMPETITION
The identified source is the only source with adequate technical data. Due to proprietary design of the main rotor blade and the lack of data available to compete the requirement, there are no other potential sources. The Government’s need cannot be met by any other source, other than the OEM. The OEM is not willing to sell data rights to the Government, which means that technical data package, specifications, and engineering description suitable for Full and Open Competition cannot be developed program and service life of the UH-1N and TH-1H helicopters is expected to be active through 2040
X. LIST OF SOURCES, IF ANY, THAT EXPRESSED INTEREST IN THE
ACQUISITION
