II. NATURE AND/OR DESCRIPTION OF THE ACTION BEING PROCESSED

This individual Justification and Approval (J&A) authorizes the use of other than full and open competition procedures to obtain a new, firm fixed price, fixed quantity, sole source contract with United Technologies Corporation, Pratt & Whitney Military Engines (Pratt & Whitney), Commercial and Government Entity (CAGE) code 52661, for the procurement of Compressor Disks for the TF33 Aircraft engine. IV. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN

COMPETITION

10 U.S.C. 2304(c)(1), as implemented by FAR 6.302-1(a)(2), “Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements”. In accordance with FAR 6.304(a)(2) the approval level for this J&A is the competition advocate.

V. DEMONSTRATION THAT THE CONTRACTOR’S UNIQUE QUALIFICATIONS OR

NATURE OF THE ACQUISITION REQUIRES THE USE OF THE AUTHORITY CITED

ABOVE (APPLICABILITY OF AUTHORITY

This Flight Safety Critical Part has been designated a high reliability part under a formal reliability program. The safety of personnel and equipment requires high safety and reliability standards that will minimize the probability of failure.

This item is considered highly specialized component of a major weapon system. This part contains critical characteristics whose failure, malfunction or absence could cause a catastrophic failure resulting in loss or serious damage to the aircraft or cause engine shutdown resulting in an unsafe condition for personnel and the surrounding environment. Accordingly, Pratt & Whitney is the only source that has specifically and uniquely designed and manufactured this part for use by the military. Pratt & Whitney has met and exceeded the standards specified for quality and reliability from past productions of this item.

The development of an additional source to produce this item would cause unacceptable delays in the repair of TF33 engines and the availability of aircrafts supported by the TF33 engine. It is imperative that these parts are readily available to ensure that the requirements of the Air Force are met. Accordingly, Pratt & Whitney is the only responsible source capable of providing the items described in Section III above.

VI. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE SOLICITED

FROM AS MANY POTENTIAL SOURCES AS DEEMED PRACTICABLE

In accordance with FAR 5.201, this requirement shall be synopsized and the request for proposal will be posted on the Federal Business Opportunities website. Qualification requirements do not apply.

VII. DETERMINATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED

COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE

The contracting officer hereby determines the anticipated cost to the Government will be fair and reasonable. A detailed cost analysis and price analysis will be conducted. The Defense Contract Management Agency (DCMA) may be contacted to assist with the price analysis if necessary and will assist with inputs throughout the life of the contract. Certified cost or pricing data will be obtained and a cost analysis will be performed.

VIII. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE RESULTS,

OR A STATEMENT OF THE REASONS MARKET RESEARCH WAS NOT

CONDUCTED

Market research, in accordance with FAR Part 10 was conducted by a multi-functional team.

This research included inquiries into internet sites including Haystack, Parts Manufacturer Approvals, Google, Thomas Register, and similar item manufacturer’s websites. The market research was accomplished on 22 August 2016. This research revealed that there were no commercial items available to meet this requirement. As described in Section VI above, market research in accordance with FAR Part 10 will be conducted by synopsis of the proposed acquisition, advising industry of the pending acquisition and soliciting inquiries from interested parties.

A Sources Sought Synopsis was also conducted on 22 August 16, during the market research effort described above to notify United Technologies Corporation, dba Pratt & Whitney Military Engines licensees, vendors, or other sources with access to the necessary data of the pending acquisition. This posting was created on the Federal Business Opportunities website under the PR number FD2030-17-00285 and closed 29 Aug 16. No vendors indicated interest in the acquisition. Based on this market research, United Technologies Corporation, dba Pratt & Whitney Military Engines Division was found to be the only source able to fulfill the requirement described in Section III.

IX. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND OPEN

COMPETITION

The qualification of a reverse-engineered part would require an Accelerated Mission Test (AMT).

TF33 AMTs occur every 4 years and cost approximately $6M (this is the cost of the 2015 AMT) and would not occur until 2019.

X. LIST OF SOURCES, IF ANY, THAT EXPRESSED INTEREST IN THE ACQUISITION

United Technologies Corporation CAGE: 52661 Pratt & Whitney Military Engines Division 400 Main St East Hartford CT 06108 860-565-5173

XI. A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO

REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE MAKING

SUBSEQUENT ACQUISITIONS FOR THE SUPPLIES OR SERVICES REQUIRED

In an effort to identify and remove barriers to competition, AFLCMC/LPSEA will continue to monitor the marketplace for source development.
