V. DEMONSTRATION THAT THE CONTRACTOR’S UNIQUE

QUALIFICATIONS OR NATURE OF THE ACQUISITION REQUIRES THE

USE OF THE AUTHORITY CITED ABOVE (APPLICABILITY OF

AUTHORITY

The rights to use the data needed to purchase this part from additional sources are not owned by the Government and cannot be purchased, developed or otherwise obtained.

Drawing 410032 is proprietary to the Original Equipment Manufacturer (OEM), Pratt & Whitney. In a letter dated 15 March 2012, the OEM stated that the data and data use rights to drawing 410032 will not be provided to the Government. Currently Pratt & Whitney is the only source for this item.

This item is a highly specialized component of an engine assigned to a major weapon system. A highly specialized component is identified by the close tolerances and significant manufacturing processes that can alter the microstructure of the item and cannot be evaluated without destructive testing. Accordingly, Pratt & Whitney possesses unique capabilities derived from knowledge and expertise gained during previous productions of this item. The development of an additional source to produce this item is not feasible within allowable timeframes. Delays in new procurement have the potential of disrupting the availability of TF33 engines, leaving the Air Force unable to meet critical mission requirements. For these reasons, Pratt & Whitney is the only known source possessing the unique capabilities to manufacture this part and that can satisfy the Government’s requirement.

VI. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE

SOLICITED FROM AS MANY POTENTIAL SOURCES AS DEEMED

PRACTICABLE

In accordance with FAR 5.201, this requirement shall be synopsized and the request for proposal will be posted to the Federal Business Opportunities website. The Government does not have qualification requirements as only the OEM approves additional sources.

VII. DETERMINATION BY THE CONTRACTING OFFICER THAT THE

ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND

REASONABLE

The contracting officer will ensure that the items described herein are negotiated at a fair and reasonable price to the Government. The contractor may be required to provide certified cost or pricing data. A detailed cost analysis and price analysis may be accomplished. The Defense Contract Management Agency (DCMA) may be contacted to assist with the analysis.

VIII. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE

RESULTS, OR A STATEMENT OF THE REASONS MARKET RESEARCH

WAS NOT CONDUCTED

Market research, in accordance with FAR Part 10 was conducted by inquires of Haystack, Parts Manufacturer Approvals, Google, and Thomas Register. This research, conducted on 30 March 2015, revealed that there is not a commercial item available to meet this requirement. The item described in section III is used in military applications and no commercial or non-developmental substitutes are available. Other companies that perform similar efforts exist in the marketplace, but they do not possess the applicable data required to meet the Government’s specifications. This is a non-developmental item. Based on all of the above, a high level of confidence exists that Pratt & Whitney is currently the only responsible source able to fulfill the requirement.

IX. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND

OPEN COMPETITION

Because of the proprietary nature of this blade, the Government does not have the required data to develop a technical data package. Reverse engineering is not feasible within reasonable time constraints. The qualification of a reverse-engineered part would require an Accelerated Mission Test (AMT). TF33 AMTs occur every 4 years and cost approximately (this is the cost of the 2015 AMT) and would not occur until 2019.

X. LIST OF SOURCES, IF ANY, THAT EXPRESSED INTEREST IN THE

ACQUISITION

United Technologies Corporation CAGE: 52661

Pratt & Whitney Military Engines Division 400 Main Street East Hartford CT 06108 860-565-5173

XI. A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO

REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE

MAKING SUBSEQUENT ACQUISITIONS FOR THE SUPPLIES OR SERVICES

REQUIRED

AFLCMC/LPSEA3 will continue to monitor the marketplace for source development, and will continue discussions with the OEM regarding additional approved sources. The Government will continue to synopsize the requirement and rescreen the item.

XII. CONTRACTING OFFICER’S CERTIFICATION

By signing the coordination and approval document, the contracting officer determines this document to be accurate and complete to the best of the contracting officer’s knowledge and belief.

XIII. TECHNICAL/REQUIREMENTS PERSONNEL’S CERTIFICATION

As evidenced by their signatures on the coordination and approval document, the technical or requirements personnel certify that any included, supporting data within their area of responsibility is both accurate and complete.
