4. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL & OPEN COMPETITION: This J&A is based upon the authority of 10 USC 2304(c) (1), only one or a limited number of responsible sources will satisfy agency requirements, as implemented by FAR 6.302-1
5. RATIONALE JUSTIFYING USE OF CITED AUTHORITY:
The current Acquisition/Repair Method/Suffix Code(s) is (are)
0. The part was not assigned AMC/RMC 1 through 5 when it entered the inventory, nor has it ever completed screening.
1. Suitable for competitive acquisition for the second or subsequent time.

Z. This part is a commercial/nondevelopmental/off-the-shelf item. Commercial item descriptions, commercial vendor catalog or price lists or commercial manuals assigned a technical manual number apply. If one source is available, A/RMCs 3, 4, or 5 are valid. If at least two sources are available, A/RMCs 1 or 2 are valid.
Multiple Method Codes
This acquisition will be negotiated with
HONEYWELL (07217); Canadian Commercial Corp (98247)
HONEYWELL (07217), will be solicited because the item to be manufactured is a highly specialized part, designed and manufactured by a Non-Government activity and the the technical data required to manufacture by other than HONEYWELL (07217) is not available. A criticality determination has been performed and this item does not have a criticality determination as the part is a commercial FAA governed item and Honeywell is the only responsible source with access to the technical data required to manufacture, test and certify that it is airworthy prior to delivery to the Navy. In the absence of a Government assigned criticality code, it is imperative that the Government deal strictly with the OEM/ Prime Vendor for procurement of this item. The Government does not physically have in its possession any engineering or technical data to contract for spares with other than the OEM/ Prime at this time. All alternate sources must qualify I/A/W the Design Control Activity procedures as approved by NAVAIR prior to award. This J&A covers FMS Spares only.
6. DESCRIPTION OF EFFORTS MADE TO SOLICIT OFFERS FROM AS MANY OFFERORS AS PRACTICABLE: A Request for Information / Sources Sought Notice was entered on the FedBizOpps website for government-wide point of entry on
5/24/2018 and as a result
No other sources expressed an interest in this acquisition.
The proposed contract action was synopsized on the FedBizOpps website for government-wide point of entry on
5/24/2018 and as a result
No other sources expressed an interest in this acquisition.
Market Research was conducted in accordance with FAR Part 10. The results of the Market Research conducted (or the reason(s) Market Research was not conducted) are as follows:
The available technical data required to facilitate procurement of this item is insufficient for the development of new sources. A criticality determination and subsequent JDRS entry has yet to be made for this item. Source Development Department files indicate no Source Approval Request (SAR) has been received from any party interested in becoming an approved source.
7. DETERMINATION OF FAIR AND REASONABLE COST:
The contracting officer determines that the anticipated cost to the Government of the supplies covered by this J&A will be fair and reasonable.
8. ACTIONS TO REMOVE BARRIERS TO FUTURE COMPETITION:
For reasons set forth in Paragraphs (5) & (6), NAVSUP WSS has no plans at this time to openly compete future contracts for the types of supplies/services covered by this document. If another potential source emerges, NAVSUP WSS will assess whether competition for future requirements is feasible.

The Government places orders for individual requirements. Quantity limits may be stated as number of units or as dollar values.
Contracting officers may use an indefinite-quantity contract when the Government cannot predetermine, above a specified minimum, the precise quantities of supplies or services that the Government will require during the contract period, and it is inadvisable for the Government to commit itself for more than a minimum quantity. The contracting officer should use an indefinite-quantity contract only when a recurring need is anticipated.
Requirements A requirements contract provides for filling all actual purchase requirements of designated Government activities for supplies or services during a specified contract period (from one contractor), with deliveries or performance to be scheduled by placing orders with the contractor: C1

| EQUIPMENT SPECIALIST: Discuss any actions planned to change conditions that preclude use of full & open competition. |
This is the paragraph that will be reviewed when attached to the next J&A. If what is stated has not been done by the next time a J&A is needed for the acquisition/repair of this item, the J&A will need to be approved by the next higher approval authority. (see PGI 206.303-2) Note: The requirement is to state how we are going to ATTEMPT to remove barriers to future competition, NOT to actually achieve competition (in other words, the approval level will not heighten just because competition was not achieved).
Examples include but are not limited to the following:
| Getting a validated technical data package | Intent to develop a 2nd source | ||
| Requesting a Budgetary Cost Quote to Buy Data | Attempting to Obtain Missing Data | ||
| Requesting Contractor Release the Proprietary Rights | Reverse Engineering |
2nd source in process of becoming qualified but urgent need precludes award for this procurement: For reasons set forth in Paragraphs (5) & (6), NAVSUP WSS has no plans at this time to openly compete future contracts for the types of supplies/services covered by this document.
