A/RMC 3

Acquire, for the second or subsequent time, directly from the actual manufacturer.

A/RMSC R

The Government does not own the data or the rights to the data needed to purchase / contract repair of this part from additional sources. It has been determined to be uneconomical to buy the data or rights to the data. It is uneconomical to reverse engineer the part. This code is used when the Government did not initially purchase the data and/or rights. If only one source has the rights or data to manufacture/repair this item, A/RMCs 3, 4, or 5 are valid. If two or more sources have the rights or data to manufacture/repair this item, A/RMCs 1 or 2 are valid.

This acquisition will be solicited to

FAIRBANKS MORSE LLC, 701 White Ave Beloit, WI 53511-5447, CAGE 7PZX0. Fairbanks Morse owns the drawings and is identified as the approved source of supply. There are no authorized substitutes of this item as this is the only item known to meet testing, performance, and capability requirements.

The Navy does not currently have in its possession any manufacturing data, supporting test equipment, and/or associated specifications required to procure this item from other sources. This item was recently purchased on 25 FEB 2020 under DLA Contract SPRMM1-20-F-LK05 by the current Contract Specialist.

Fairbanks Morse was the only quote received and no alternate sources notified of their interest in quoting.

15 MAR 2019 Class Waiver of the Requirement to Post a Request for Information or Sources Sought Notice applies to this requirement

The proposed contract action was synopsized on the government-wide point of entry on 08/17/2020 and as a result The proposed contract action will be synopsized 15 days prior to the release of the solicitation.

Market research was conducted in accordance with far part 10. The results of the market research conducted (or the reason(s) market research was not conducted) are as follows

A technical review, which consisted of searching several Government databases including ITIMP, NSEDR, FLIS and ERP, has been completed on this item.

Search criteria included Part Number, Design Control Activity, CAGE Code, NSN, Nomenclature, AMC/AMSC, AAC, Criticality Coding, recorded approved source of supply, historical sources of supply and past contracts. Based on this market research the contracting officer has determined that the only known manufacturing source is Fairbanks Morse LLC., CAGE: 7PZX0 and the Government's needs cannot be met by a commercial item. If a company other than the one listed believes it has a compatible product, they can submit the item to the Engineering Program Office, to include research and development, drawings, and test specifications. The program office will test and evaluate the item at the company's expense. Upon qualification, the approved company will be able to participate in current and future solicitations. The website Webflis shows a second potential source, Coltec Industries (CAGE: 82796), however the CAGE Status is "R", or cancelled. There is no record of this CAGE code on the System for Award Management (SAM). The CAGE code is listed in ITIMP with the name "Coltec Industries d/b/a Fairbanks Morse Engine." An internet search reveals that Coltec Industries was acquired by Fairbanks Morse parent company in 2002. Therefore, there is only one known source of supply - Fairbanks Morse LLC (CAGE: 7PZX0).

I hereby determine that the anticipated cost to the Government for this contract action will be fair and reasonable. This item has been procured on a non-commercial basis in the past and is for a specific military application. However, the total estimated cost is lower than the threshold for providing certified cost or pricing data as provided for in FAR15.403-4(a)(1). Any necessary price analysis or cost information will be used to support the reasonableness of the price.

8. Actions to Remove Barriers to Future Competition

9. Any Other Facts Supporting Other Than Full & Open Competition

History

To promote competition, NAVSUP WSS (WSS) will continue to encourage vendors with the expertise to manufacture/repair the subject item to submit a complete technical data package (TDP) for review and source approval by the appropriate engineering source approval authority per the WSS guidelines.

Vendors that qualify through the in-service engineering agent (ISEA) certification process will be added as additional sources. Also, future requirements will be advertised in the Contract Opportunities section of https://beta.sam.gov/. If another potential manufacturing source emerges, WSS will assess whether competition for future requirements is feasible. The Government will include remarks in this solicitation that alternate offerors who are interested in qualifying their product for the purpose of future acquisitions must contact the design control activity specified on the source control drawing. Offerors should submit a complete technical data package that will be referred to the cognizant engineering activity. The current procurement cannot be delayed in order to allow sufficient time for the engineering activity to determine whether to approved any alternate source/offer. The technical data package will be considered for future awards. Future requirements will be advertised on the Beta Sam website (www.beta.sam.gov). This is the first procurement utilizing the authority of 10 U.S.C. 2304 (c)(1) for NSN 2815-011912721.
