Defense Logistics Agency Aviation
About this file
This is a Justification for Other Than Full and Open Competition (sole source justification) document for a Defense Logistics Agency (DLA) procurement.
DLA Weapons Support Ogden is procuring 37 Enhanced Microwave Unit (EMU) sub-assemblies from BAE Systems (CAGE Code 12436), a large business located in San Diego, California. The EMU sub-assemblies provide Radio Frequency (RF) stimulus and measurement capabilities for VXI-IAIS test stations used in testing and repair of F-16 avionics Line Replaceable Units (LRUs). The requirement is being acquired using sole source authority under 10 U.S.C. 3204(a)(1) and FAR 6.302-1 (Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements). The estimated delivery completion is 42 months after contract receipt, with FY26 working capital funding. Specific pricing and total contract value are redacted in the document.
The justification is based on BAE's status as the Original Equipment Manufacturer and engineering authority for all generations of F-16 AIS test stations. BAE recently completed a three-year redesign of the EMU to resolve Diminishing Manufacturing Sources and Material Shortage (DMSMS) issues. The EMU maintains an AMC/AMSC code of 3/R, meaning manufacturing data is proprietary to BAE; the Government does not possess sufficient data to establish additional sources. BAE declined the Government's June 12, 2025 inquiry regarding the sale of proprietary data rights. A combined Request for Information and Sources Sought Synopsis was posted to Sam.gov on October 21, 2025 (solicitation number SPRHA1-26-R-0041), with no additional sources expressing interest. Market research confirmed no viable commercial or non-commercial alternatives exist. The contracting officer is Rocky Tello (385-591-0014), PR Number FD2020-26-00041.

Basic Requirement
NSN NOUN QTY UNIT PRICE TOTAL PRICE
6625-01-721-8870WF EMU 37 $ $
TOTAL POTENTIAL CONTRACT VALUE: $
Estimated delivery completion is 42 months after receipt of contract.
The AMC Code is 3/R meaning the manufacturing data is proprietary to the OEM.
IV. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN COMPETITION
10 U.S.C. 3204(a)(1) , as implemented by FAR 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.
V. DEMONSTRATION THAT THE CONTRACTOR’S UNIQUE QUALIFICATIONS OR NATURE
OF THE ACQUISITION REQUIRES THE USE OF THE AUTHORITY CITED ABOVE
From the inception of the F-16 aircraft, BAE has been the Original Equipment Manufacturer (OEM) for the AIS series of test stations, to include the VXI-IAIS. BAE is the Engineering authority for all generations of test stations, supplying the Government with a cradle-to-grave approach in support of production, repair, and sustainment requirements for both legacy and new production test stations.
As the Original Equipment Manufacturer (OEM), BAE possesses the critical engineering, manufacturing, and repair capabilities to maintain the EMU and its subcomponents. BAE provides the Government with system and sub-system level support for every aspect of AIS test stations in order to ensure operational capability for the USAF as well as FMS F-16 customers throughout the world.
BAE recently completed a project to re-design the EMU for the VXI-IAIS test station. The three-year effort resolved Diminishing Manufacturing Sources and Material Shortage (DMSMS) issues the legacy microwave unit was experiencing and provided the Government with a long-term solution to radio frequency testing capability. No other vendor has the proprietary data required to re-deign/re-engineer and integrate another solution that will work with the F-16 AIS test systems.
The EMU maintains an AMC/AMSC of 3/R, meaning the manufacturing data is proprietary to BAE and therefore the government does not possess sufficient data to establish additional sources of supply. The Government contacted BAE via email on 12 June 2025 to see if they would be interested in selling their proprietary data. BAE responded the same day indicating they would not be interested in selling their data rights.
VI. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE SOLICITED FROM AS
MANY POTENTIAL SOURCES AS DEEMED PRACTICABLE
This requirement will be synopsized on Contract Opportunities as required by FAR 5.201. It is anticipated that sources having an interest in subcontracting may be identified through synopsis. Although the Government does not own data to support acquisition of this EMU from any other source, any source who responds to the Government as a result of this synopsis will be identified to the prime contractor as a potential source for subcontracting possibilities.
A combined Request for Information and Sources Sought Synopsis was posted to Sam.gov on 21 October 2025.
The solicitation number is SPRHA1-26-R-0041. No additional sources have expressed interest in the pending acquisition. Any new or additional information related to interested suppliers will be documented in the official contract file.
VII. DETERMINATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED COST
TO THE GOVERNMENT WILL BE FAIR AND REASONABLE
The following steps will be taken to ensure that the anticipated cost of this acquisition will be fair and reasonable. The Contracting Officer will comply with the procedures and criteria contained in Federal Acquisition Regulation (FAR) under Part 30 - Cost Accounting Standards, Part 31 - Contract Cost Principles and Procedures, Subparts 15.4 - Contract Pricing; to include technical evaluations and audits, as appropriate.
Additional steps to ensure price reasonableness will be under the guidance of the Contract Pricing Reference Guides, jointly developed by the Federal Acquisition Institute and the Air Force Institute of Technology. The Contracting Office will obtain certified cost and pricing data IAW FAR Subpart 15.403, when required. The final step is to include the Price Negotiation Memorandum (PNM). This detailed documentation and justification of price reasonableness will be disclosed in the official PNM, to be prepared upon completion of negotiations.
VIII. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE RESULTS, OR
STATEMENT OF THE REASONS MARKET RESEARCH WAS NOT CONDUCTED
The Government does not possess the data rights to the set of technical drawings and performance specifications required to procure these parts from sources other than BAE Systems (CAGE 12436).
In accordance with the FAR and to ensure Market Research is both continuous and relevant, a Combined Request for Information and Sources Sought Synopsis was issued by the contracting officer, any new or additional information related to interested suppliers will be documented in the official contract file.
Internet searches were performed as well as queried government databases, vendor surveys, and correspondence with Subject Matter Experts (SMEs) and other individuals that are knowledgeable within the industry were performed, including contacting known sources of supply. There was no conclusive evidence that another source, other than the OEM, can satisfy this requirement.
Based on the research conducted and due to the highly specialized and unique nature of the complex redesign of the F-16 EMU subassembly, no viable substitute system/component could be identified to support this immediate requirement. There are no identified commercial/non-commercial alternatives currently on the market that will satisfy this requirement.
Based on the research conducted and due to the highly specialized and unique nature of the F-16 EMU, it is recommended that this spares acquisition be awarded to BAE as it determined; no other vendor has the proprietary data required to re-deign/re-engineer and integrate another solution that will work with the F-16 AIS test systems.
IX. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND OPEN
COMPETITION
The Government does not possess the data rights to the set of technical drawings and performance specifications required to procure these parts from sources other than BAE Systems (CAGE 12436).
X. LIST OF SOURCES, IF ANY, THAT EXPRESSED INTEREST IN THE ACQUISITION
See Section VI above.
XI. A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO REMOVE OR
OVERCOME ANY BARRIERS TO COMPETITION BEFORE MAKING SUBSEQUENT
ACQUISITIONS FOR THE SUPPLIES
The Government will attempt to reduce competition barriers by continuously monitoring Industry and making additional inquiries regarding the purchase of proprietary data rights from BAE.
