About this file

This is a Justification and Approval (J&A) document for sole source procurement SPRDL1-25-R-0210 by the Defense Logistics Agency Land-Warren (DLA-WRN) on behalf of the Integrated Logistics Support Center Detroit Arsenal.

The procurement involves awarding a firm-fixed-price contract to Thermo Scientific Portable Analytical Instruments, Commercial and Government Entity (CAGE) 392A9, for Handheld Identifier units (NSN 6665-01-706-8739, part number 800-03009-01). The Government requires 44 total units: a base quantity of 22 each plus an option quantity of 22 each, with an estimated 90-day delivery timeline. The Handheld Identifier is used by the U.S. Army Combat Capabilities Development Command Chemical Biological Center to identify chemical warfare agents, toxic industrial chemicals, and toxic industrial materials. The justification for sole source award cites that Thermo Scientific is the only approved source capable of producing this product, as it is equipped with proprietary microSD card software modifications specific to the Dismounted Reconnaissance Sets, Kits, and Outfits (DR SKO) configuration. The Government possesses the Technical Data Package but cannot legally obtain the intellectual property or reverse engineer a competitive design within reasonable timeframes or costs. Market research confirmed competing instruments (Agilent Resolve and Smiths Detection HazMatID Elite) lack microSD card compatibility and cannot meet requirements. Alternative competitive procurement would cost approximately $27.5 million and require multiple years. The contract is authorized under 10 U.S.C. § 3204(a)(1) as a sole source acquisition where only one responsible source exists. The contract will include standard FAR clauses requiring subcontracting competition and small business utilization unless awarded to a small business. The Competition Advocate approved the procurement on September 4, 2025, and the Contracting Officer certified fair and reasonable pricing based on commercial product analysis.

SPRDL1-25-R-0210 (JA-01122)

Previous J&A: Not Applicable

7. Efforts to Obtain Competition:

a. Effective competition: Due to the reasons cited in Section 5, the Government is not pursuing competition for this item. The notices required by FAR 5.201 shall be published, and any bids or proposals received shall be considered. Sole Source Notices required by FAR 5.201 will be posted.

b. Subcontracting competition: Unless the contract is awarded to a small business, the solicitation and resulting contract will include FAR clauses 52.219-8, "Utilization of Small Business Concerns", 52.244-5, "Competition in Subcontracting", 52.219-16, "Liquidated Damages--Subcontracting Plan"," and Defense Federal Acquisition Regulation Supplement 252.219-7003, "Small Business Subcontracting Plan (DoD Contracts)", to maximize small business opportunities and utilization.

8. Actions to Increase Competition: There are no plans to increase competition for future procurements due to the reasons cited above.

9. Market Research: A Sources Sought Notice was posted to SAM.gov on 01 July 2025 and was open for 15 days. Two responses were received from distributors of Thermo Scientific that will receive a copy of the solicitation once it is publicly released on SAM.gov.

DEVCOM CBC Engineering contacted Thermo Scientific (CAGE 392A9) on 17 April 2025 to verify that Thermo Scientific is still manufacturing the Handheld Identifier. A response received on 17 April 2025 confirmed product availability.

The following two websites were found that had comparable instruments:

(1) Keywords: handheld chemical warfare agent identifier

Website: https://www.agilent.com/en/product/molecular-spectroscopy/raman-spectroscopy/handheld-raman-chemical-detection-systems/resolve-handheld-raman-analyzer-for-through-barrier-chemical-identification

Findings: The Agilent Resolve Handheld Raman Analyzer is not feasible for usage because it does not appear to have a place to insert a microSD card. As mentioned previously, the microSD card modifies the software, making it specific to the DR SKO.

(2) Keywords: smiths detection hazmatid elite

Website: https://www.smithsdetection.com/products/hazmatid-elite/

SPRDL1-25-R-0210 (JA-01122)

Previous J&A: Not Applicable

Findings: The HazMatID Elite from Smiths Detection is not feasible for usage because it does not appear to have a place to insert a microSD card. As mentioned previously, the microSD card modifies the software, making it specific to the DR SKO.

DEVCOM CBC Engineering contacted Thermo Scientific to request consideration for the U.S. Government to purchase the intellectual property. Thermo Scientific stated on 22 July 2025 that the technical data used to produce the Handheld Identifier is not for sale.

10. Interested Sources: To date no additional sources have expressed interest in this item.

Two inquiries were received in response to the Sources Sought Notice; One from an unconfirmed authorized distributor of the approved source, Thermo Scientific Portable Analytical Instruments, Inc., and another from a company claiming to be a distribution partner of Thermo Fisher (parent company of Thermo Scientific). Both companies' intention is to supply the product of Thermo Scientific.

11.Other Facts: Procurement History:

There is no procurement history for the Handheld Identifier.

12. Technical Certification: I certify that the supporting data under my cognizance which is included in the justification is accurate and complete to the best of my knowledge and belief.
