JUSTIFICATION AND APPROVAL

FOR OTHER THAN FULL AND OPEN COMPETITION

SPRDL1-25-R-0143

1. Contracting Agency: Defense Logistics Agency - Land Warren (DLA-WRN).

2. Description of Action: DLA-WRN proposes to award a new firm-fixed-price contract to an offeror providing the product of Cummins Inc, Commercial and Government Entity (CAGE) 56664, for National Stock Number (NSN) 2520-01-665-5435, Transfer Case and Shipping and Storage Container, using Army Working Capital Funds.

3. Description of Supplies/Services: The NSN 2520-01-665-5435, part number 57K8953, Transfer Case and Shipping and Storage Container, is used on the Buffalo Mine-Protected Clearance Vehicle M1272. The Transfer Case is the part of the mechanism of a vehicle which distributes engine torque from the transmission and provides a means to transfer it, usually, to the front and rear driving axles. The deliverable for this contract is for a base quantity of 9 each, with an option quantity of 9 each, making a total quantity of 18 each. The total maximum value of this contract is

4. Authority Cited: The statutory authority permitting other than full and open competition for this effort is 10 United States Code (U.S.C.) 3204(a)(1) as implemented by FAR 6.302-1 Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.

5. Reason for Authority Cited: The Buffalo Mine-Protected Clearance Vehicle M1272 (Buffalo) Government part number Kit 57K8953, NSN 2520-01-665-5435, CAGE 19207, includes a shipping and storage container, part number 12575018, NSN 8145-01-673- 4360, CAGE 19207, and a transmission transfer case, Cummins Inc. (Cummins), formerly Meritor Specialty Product part number 315N-6, NSN 2520-01-579-7874, CAGE 56664. The original equipment manufacturer for Buffalo was Force Protection which was acquired by General Dynamics Land Systems (GDLS), CAGE 1EFH8. The transmission transfer case, NSN 2520-01-579-7874, was supplied by Cummins, (formerly Meritor Inc. and formerly Cushman), part number 315N-6. Ground Vehicle Systems Center (GVSC) Vehicle Sustainment engineer contacted GDLS who advised the transmission transfer case is no longer in production and therefore no longer engineering the item to create a competitive build-to-print TDP within a reasonable time frame. At the current average usage rate of , a current unit cost of $ , and assuming 25% savings achieved through competition, the $ in annual savings would take over to offset the estimated cost of reverse engineering the item and qualifying another source.

6. Efforts to Obtain Competition:

a. Effective competition: Due to the reasons cited in section 5 above we are limiting the competition to the sources cited in section 2 above. Notices required by FAR

5.201 will be posted.

b. Subcontracting competition: Unless the contract is awarded to a small business, the solicitation and resulting contract will include FAR clauses 52.219-8, "Utilization of Small Business Concerns"; 52.244-5, "Competition in Subcontracting"; 52.219-16, "Liquidated Damages--Subcontracting Plan";" and Defense Federal Acquisition Regulation Supplement (DFARS) 252.219-7003, "Small Business Subcontracting Plan (DoD Contracts)," to maximize small business opportunities and utilization.

7. Actions to Increase Competition: There are no plans to increase competition for future procurements due to the reasons cited above.

8. Market Research: A Sources Sought Notice was posted to SAM.gov on 20 March and was open for 14 days. No responses were received.

Market research was performed by the GVSC Sustainment Engineer in March 2025 via internet searching with key words, commercial vehicle transfer case, heavy truck transfer case and transfer case.

Cummins is the original equipment manufacturer of the Buffalo transfer case. Engineer confirmed Cummins, CAGE 56664, , can supply the transfer case to the Government through their authorized distribution network included below:

Spicer transfer cases provide the power of all-wheel drive, to drive across sand, mud, ice, or snow, with maximum power in all transmission speeds and in most off-highway applications, Spicer transfer cases can be coupled without modifications directly to a Spicer auxiliary transmission, providing full torque capacity to both front and rear axles.

Modifications or possibly a complete redesign are needed to couple the Spicer transfer case to the Buffalo transmission supplied by Caterpillar. Therefore, engineer does not recommend the Spicer transfer case as a viable solution for the Buffalo program.

Per United States Powertrain website, they have 50 years of experience with the automotive industry. Their website did not reference military or heavy truck products.

Engineer contacted their online support who confirmed that the Buffalo transfer case is not available. Therefore, the US Powertrain transfer case is not a viable solution for the Buffalo program.

Powertrain Products, Inc

Established in 2007, Powertrain Products is the nation’s leading supplier of remanufactured, used, and surplus engines, transmissions, differentials, and transfer cases. Their website does not reference military or heavy truck products. Therefore, the Powertrain Products transfer case is not a viable solution for the Buffalo program.

Red River Army Depot Engineer contacted Red River Army Depot (RRAD), per , Equipment Specialist, email , RRAD cannot supply the transfer case.

Findings: Commercial transfer cases offered by Cummins, Spicer, US Powertrain, and Powertrain Products were reviewed. The materials, dimensions, mounting details, and performance requirements are not available for this assembly. Due to the lack of a TDP or in-depth technical specifications of the sole-source part, the validity of researched transfer cases is difficult to evaluate. Other manufacturers offer similar transfer cases, but there is not enough technical information available to verify other manufacturers could meet the same form, fit, and function on the vehicle and operate in the same manner as the sole-source part. Therefore, the information found via the internet search was not sufficient to evaluate for military application due to the lack of critical technical information.

Summary: As a result of the market research, it was concluded that the Government does not have enough detailed technical data information to investigate similar parts for direct replacement of the transfer case for this specific application. Since the Buffalo is a sustainment program, funding is not available for the extensive vehicle system changes that may be required to accommodate an alternative transfer case. Therefore, engineer recommends procurement from an authorized Cummins distributor listed above. .
