About this file
This is a Justification and Approval (J&A) document for a non-competitive federal procurement action.
The Defense Logistics Agency – Land Warren (DLA-WRN) proposes to award a new firm-fixed-price, five-year Indefinite Delivery Indefinite Quantity (IDIQ) contract to JCB, Inc. for the supply of Wheel Assembly, Pneumatic components (NSN 2530-01-598-4010, part number 34720198) used on High Mobility Engineer Excavator – Type I (HMEE-I) vehicles. The contract guarantees a minimum quantity of 212 units over five years with an estimated maximum quantity of 2,475 units. The maximum contract value is redacted in the document. The Acquisition Method Code is 3 (acquire for the second or subsequent time directly from the actual manufacturer), and the Acquisition Method Suffix Code is R, indicating the Government does not own proprietary data rights and reverse engineering is uneconomical.
The procurement is restricted to JCB, Inc. as the sole source under the authority of 10 U.S.C. § 3204(a)(1) per FAR 6.302-1 (Only One Responsible Source). Justification for single-source award includes JCB's exclusive ownership of Technical Data Package (TDP) for the wheel assembly, the prohibitive cost of reverse engineering (estimated at a redacted amount for development, testing, and certification), and the absence of competitive alternative sources despite market research. Market research conducted January 16-19, 2025 included a Sources Sought Notice posted December 3, 2024 (15-day open period yielding no responses except JCB acknowledgement) and searches of major tire manufacturer websites (Goodyear, Michelin, Bridgestone) and Google, all yielding no alternative suppliers. The procurement history shows three previous limited-source contracts awarded to JCB or its authorized distributor Giga, Inc. between 2014 and 2019, valued between $386,000 and $3,431,225. Small business subcontracting requirements apply unless the contract is awarded to a small business. The contracting officer (Leah Bourdeau) has determined the anticipated cost is fair and reasonable based on detailed cost/price analysis, with the item classified as a commercial product requiring no certified cost or pricing data submission.
