About this file

This is a Justification and Approval (J&A) document for other than full and open competition for a contract award by the Defense Logistics Agency - Land Warren (DLA-WRN). DLA-WRN proposes to award a firm-fixed-price contract to General Dynamics Canada LTD (CAGE 05257) for National Stock Number (NSN) 5999-01-568-6545, a Flat Panel Display used on Bradley M2A3 and M3A3 turrets. The contract calls for a base quantity of 1,070 units with an option quantity of 1,070 units, totaling 2,140 units. The contract is justified under 10 U.S.C. 3204(a)(1) and FAR 6.302-1 (Only One Responsible Source) because General Dynamics Canada LTD is the sole Original Equipment Manufacturer and only approved source capable of meeting Government requirements. The Government does not own the Technical Data Package or intellectual property rights necessary for competitive re-procurement, and reverse engineering is deemed uneconomical. Previous contracts for this item were awarded to Canadian Commercial Corporation in June 2012 (SPRDL1-12-C-0131, $2,008,520), February 2020 (SPRDL1-20-C-0089, $7,486,766), and April 2023 (SPRDL1-23-C-0047, $11,836,890).

The J&A documents that market research was conducted through a Sources Sought Notice posted on SAM.gov on January 10, 2024 (open for 15 days), with no responses received. A Google search and I2Log research found no alternative sources. General Dynamics Canada LTD has redesigned the Flat Panel Display at a fraction of the current production cost and can produce units at a rate of fifty per month. The Army Combat Capabilities Development Command estimates reverse engineering would take approximately several months based on specified technical tasks. No subcontracting set-asides are specified. The estimated total contract value is redacted. The justification was certified by the Chief of Configuration Management Division and approved by the Head of Contracting Activity for acquisitions between $15 million and $100 million.
