Previous J&A: SPRDL1-19-R-0327 and on vehicle tests. The USG further noted �Although motors from both vendors meet the Army�s TDP requirements, these requirements are too generalized and lack not only the proprietary internal design of each vendor�s motor, but also the specific performance specifications to enable the motor to properly function with the A3 Turret.�
Additionally, previous J&A SPRDL1-19-R-0327 observed �In 2008, using what the U.S.
Army believed to be an adequately defined TDP, the Army attempted, via Contract W52H09-08-C-0045, to develop an additional source of supply. This resulted in an additional contractor designing and producing motors that passed all the drawing and specification requirements the Army had available at that time. However, these new motors then failed the on-vehicle A3 Bradley Turret rotation tests at the Bradley Prime Contractor�s Plant (BAE Systems, Inc., Santa Clara, CA 95050, CAGE 80212). The motors� inability to pass on-vehicle performance testing requirements while conforming to the physical drawings and specifications reflected that these drawings/specifications contained in the Army�s TDP were inadequate for competitive acquisition.�
The Government does not have rights to the TDP or specifications. Skurka Aerospace CAGE 95270 and Kollmorgen Inc. CAGE 11384 own the proprietary internal design of the Brush less Traverse Drive Motor. The Government has no technical data for the proprietary internal design of each Traverse Drive Motor produced by these vendors. No other companies have access to the proprietary technical data or test equipment owned by the qualified vendors. The U.S. Government does not have any additional information at this time that can be used to compete this requirement, and there is no process underway, or funding by which competition can be technically supported in a responsible time frame.
As addressed above, Skurka Aerospace CAGE 95270 and Kollmorgen Inc. CAGE 11384 own all technical data rights for this component. Complete Level III TDPs, suitable for competition, are not available for purchase. To develop technical data, the Government would need to reverse engineer these components which would not be practicable since there is no funding to qualify a new vendor. There are no vendors currently in the process of being qualified. There are no current or planned efforts to qualify any additional sources for the reasons listed above, including the fact that there is no funding for this effort. Although this procurement will be restricted to the above source, every effort will be made to obtain potential sources by synopsis and posting to the SAM.gov website.
As indicated above, the Government does not have a means of obtaining adequate information in a responsible time frame. Funding for a reverse engineering effort has not been budgeted for any future procurements of this item. It is estimated that a reverse engineering effort would take 12 months and $200,000 to obtain fully competitive technical data. This contractor would then need an additional 12 months and $500,000 to produce prototypes for both in-house and on-vehicle testing to qualify their design of this item for use on the Bradley Turret. It should be noted that during this process, there is no guarantee that this process would result in a vendor becoming a qualified production source for this item. Additionally, qualification of a vendor would not guarantee any large decrease in unit cost. If the unit purchase price were to drop as much as 25 percent because of having additional offers, the time to recoup these costs would not justify the effort expended.
6. Efforts to Obtain Competition:
a. Effective competition: Due to the reasons cited in section 5 above, the Government is not pursuing competition for this item.
b. Subcontracting competition: Unless the contract is awarded to a small business, the solicitation and resulting contract will include FAR clauses 52.219-8, "Utilization of Small Business Concerns"; 52.244-5, "Competition in Subcontracting"; 52.219-16, "Liquidated Damages--Subcontracting Plan", and Defense Federal Acquisition Regulation Supplement (DFARS) 252.219-7003, "Small Business Subcontracting Plan (DoD Contracts)", to maximize small business opportunities and utilization.
7. Actions to Increase Competition: There are no plans to increase competition for future procurements due to the reasons cited above.
There are currently no contractors in the process of being qualified at this time or prior to the contract award due to funding constraints. The funding associated with qualifying a new source would not be recovered through subsequent competition within a reasonable time. Accordingly, qualifying a new source would not be in the best interest of the Government at this time. Notices required by FAR 5.201 will be posted.
8. Market Research: A Sources Sought Notice was posted to SAM.gov on 14 November 2023 and was open for 15 days. No responses were received.
In accordance with the tenets set forth in FAR 10.002(b)(2)(vii), Market Research was conducted by the U.S. Army, Combat Capabilities Development Command � Armaments Center, Rock Island on 25 October 2023. An online search for the words �Brush less Traverse Motor� �Bradley Fighting Vehicle� and �NSN 6105-01-462-7177� was conducted and the results indicated that there are no alternative sources that would meet the known requirements.
On 25 October 2023, an Engineer from the U.S. Army Combat Capabilities Development Command � Armaments Center, Rock Island Arsenal, performed market research, including a search on https://midwestmotion.com using keywords: Brush less Traverse Motor. There are various motors available with different sizes and design. Due to lack of technical data, the Government cannot determine one to replace the current part from Skurka Aerospace CAGE 95270 and Kollmorgen Inc. CAGE 11384 that meets the requirements and the on-vehicle A3 Bradley Turret rotation tests.
Based on the Market Research for Commerciality Determination Memorandum dated and approved by the Contracting Officer on 15 November 2023, the prior commercial award of Contract SPRDL1-21-C-0016 and the overall market research conducted, it was verified that this product meets the definition of a commercial product as defined in
13. Fair and Reasonable Cost Determination: I hereby determine that the anticipated cost to the Government for this contract action will be fair and reasonable. This determination will be based on price analysis on the basis that this product is considered commercial. The contractor will not be required to submit certified cost or pricing data.
