About this file
This document is a Justification and Approval (J&A) for a sole source procurement. It provides details on the requirement for a Thermostatic Temperature Regulator, including the lack of competition, market research efforts, and the planned single-source award to an unknown vendor.
The J&A states that the government conducted market research, including posting a Sources Sought notice and reviewing commercially available products, but was unable to identify any alternatives that met the required technical specifications. The estimated cost to reverse engineer the item is $850,000, and the anticipated savings from the sole source award is 10% of the annual demand over 10 years. The government plans to post a notice of the sole source justification, and there are no plans to increase competition for future procurements of this item. The sole source award, contract number SPRDL1-24-C-0022, was made on February 15, 2024 to an unknown vendor for an unknown amount.

Previous J&A is not available
Calculation: Cost to Reverse Engineer / (Average U/P X annual demand x 10% assumed savings) or $850,000.00 / ( x 12 x .10) = years.
6. Efforts to Obtain Competition:
a. Effective competition: Due to the reasons cited in section 5 above we are not pursuing competition for this item.
b. Subcontracting competition: Unless the contract is awarded to a small business, the solicitation and resulting contract will include FAR clauses 52.219-8, “Utilization of Small Business Concerns”; 52.244-5, “Competition in Subcontracting”; 52.219-16, “Liquidated Damages-Subcontracting Plan”; “and Defense Federal Acquisition Regulation Supplement (DFARS) 252.219-7003, “Small Business Subcontracting Plan (DoD Contracts)”, to maximize small business opportunities and utilization.
SOLE SOURCE: Notices required by FAR 5.201 will be posted.
7. Actions to Increase Competition: There are no plans to increase competition for future procurements due to the reasons cited above.
8. Market Research: A Sources Sought Notice was posted to SAM.gov on 28 February 2023, and was open for 15 days. No responses were received.
On April 5th, 2023, GVSC engineering conducted market research by utilizing the internet with a search of the phrase ‘Thermostatic Temperature Regulator.’ Market research conducted by GVSC indicated that McMaster-Carr, AMOT, and Jordan Valve produce a similar regulator. However, these products did not meet the performance requirements to qualify the subsequent companies as a source of supply. The similar regulator made by McMaster-Carr did not have the dimensions required per Note 11 of the Thermostatic Temperature Regulator drawing (DWG #: 12466455). The similar regulator made by AMOT did not have the dimensions required per Note 11 of the Thermostatic Temperature Regulator drawing (DWG #: 12466455) and it did not have the required pressure ratings per Note 5A of the Thermostatic Temperature Regulator drawing (DWG #: 12466455). The similar regulator made by Jordan Valve did not have the dimensions required per Note 11 of the Thermostatic Temperature Regulator drawing (DWG #: 12466455).
On April 5th, 2023, GVSC engineering conducted internal research of Government drawing repository and provisioning websites, ePDM and WebFlis. This was done utilizing a search of the phrases ‘Thermostatic Temperature Regulator.’ Upon review of the results, there were no other regulators that would meet the performance specifications needed in drawing 12466455.
