JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

SOLICITATION SPRBL1-24-R-0003

DLA Land & Maritime Justification for Other Than Full & Open Competition (October 2020) jurisdiction over the part in the intended application. If one source is approved, AMCs 3, 4, or 5 are valid. If at least two sources are approved or if data is adequate for an alternate source to qualify in accordance with the design control activity's procedures, AMCs 1 or 2 are valid.

6. Efforts to ensure that offers are solicited from as many sources as practicable are:

7. I hereby determine that the anticipated cost to the Government will be fair and reasonable. As the Contracting Officer, I hereby determine that the anticipated cost to the Government will be fair and reasonable based on the use of some combination of cost/price analysis, a comparison of proposed prices with an Independent Government Estimate, past purchases, or other than certified cost and pricing data.

8. Market Research/Efforts to Obtain Competition:

The U.S. Army’s Communication-Electronics Command (CECOM) issued a Sources Sought Announcement (SSA) through the Government Point of Entry (GPE) SAM.gov to find potential sources capable of producing the EPP spares needed to support this requirement. The SSA was posted to the GPE from July 2, 2022, to October 7, 2022, with NSNs, part numbers, and CAGE codes to identify the required components. Vincorion Power System GmbH also was the only company that responded to the announcement.

The Contract Specialist conducted an internet search of the IHS Haystack Gold database,Army i2Log, and Federal Information Service (WebFLIS) during the month of October 2023. Current market research has not yielded any other sources that can meet the Government’s requirements.

Market Survey [10 U.S.C. 3204(e)(2)(D)]:

Total number of vendors contacted: 1.

Names of vendors contacted and responding: Vincorion was the only responder to Sources Sought.

Techniques used to conduct survey: Publicly announced Sources Sought on SAM.gov site.

Types of information requested: The SSA requested interested parties to respond with the following information:

company name, CAGE, lead time, price break ranges, and any other relevant information related to these items.

Summary of information received: The only industry source that has expressed interest in supplying this part is Vincorion (Jenoptik Advanced Systems LLC CAGE): 1VD61. Vincorion is a valid source of supply that has a history of supplying this part.

Information received regarding the commerciality of the item(s): Previous procurements of these items were not conducted utilizing commercial acquisition procedures. These parts are not commercial and FAR Part 12 procedures will not be used.

9. Additional facts supporting other than full and open competition are:
