JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION

SOLICITATION SPRBL1-20-R-0015

1. The Defense Logistics Agency (DLA) Land at Aberdeen

2. The action being approved is the acquisition of supplies/services on other than full and open competition basis.

This procurement will be a Firm-Fixed-Price (FFP), Purchase Order with no options. Army Procurement Appropriation will be used to fund this effort.

41 U.S.C. §1903 - Available from only one or a limited number of sources.

Brief Narrative supporting the situation and weapons system.

The ASIC chip in question is a critical component of EAGLE-M, an M-Code GPS system produced by Raytheon, Inc. for use in the Army's rotary-wing aircraft. Without this chip, the EAGLE-M receiver cannot use the M-Code signal to communicate with GPS satellites or provide navigational data to the helicopter's crew.

Application-Specific Integrated Circuits (Commonly referred to as "ASICs" or "ASIC chips") are specialized computer chips designed for a single purpose ("Application", here, referring to a purpose/mission rather than a software program). They may incorporate capabilities not commonly found in general-purpose chips, reduce complexity/cost by omitting unnecessary features, or both.

"M-Code" or "Military Code" is a restricted-use GPS signal designed for military users. It is intended to be more resistant to enemy jamming than other GPS systems, to function even when allied jamming systems are in use, and to be more secure than older and civilian-accessible GPS systems. Neither civilian/commercial GPS systems nor older/non-upgraded military GPS systems can make use of M-Code signals.

Currently, DoD-purchased GPS receivers must be capable or using the M-Code signal, unless granted a waiver to use a receiver that is only capable of using older, less secure, and less effective GPS signals.

Raytheon is both the sole producer and the only known Department of Defense-certified foundry for this chip.

The US government does not own the rights/drawings for this chip.

[X] AMSC D. The data needed to acquire this part competitively is not physically available, it cannot be obtained economically, nor is it possible to draft adequate specifications or any other adequate, economical description of the material for a competitive solicitation.

Efforts to ensure that offers are solicited from as many sources as practicable are:

6. I hereby determine that the anticipated cost to the Government will be fair and reasonable.

As the Contracting Officer, I hereby determine that the anticipated price to the Government for this contract action will be fair and reasonable. In accordance with 15.403-4(a)(1), certified cost and pricing data will be not be required for this part as the estimated cost is under $2,000,000. If required, to determine fair and reasonable pricing, data other than certified cost and price data will be requested. The proposed contract action will result in a C- type contract action for 2500 M-Code ASIC chips.

7. Market Research/Efforts to Obtain Competition:

Market research was conducted through the use of catalogs, periodicals, publications and other sources (Thomas Register, IHS Engineering-Haystack Parts and Logistics, etc.) and the Government found no other sources than Raytheon who would have the capability to manufacture this M-Code ASIC chip. Furthermore, the M-Code ASIC chip has to be manufactured from a trusted DoD certified foundry. Raytheon is the only company, which satisfies all of these requirements. The GPS ASIC Foundry was selected at the DoD level, and Raytheon is the only know source to manufacture these GPS M-Code ASIC chips.

The Government will continue to conduct market research to ascertain if changes occur in the marketplace that would enable future actions for these items to be competitive.
