Honeywell, the manufacturer of the INU, is the only known source with knowledge of the design that can meet the Government’s spare and repair requirements. Without the complete TDP for the INU, it is anticipated that reverse engineering efforts would result in extensive delays in meeting the Government’s requirement and delivery expectation. The Government requires deliveries within 9 months after award of a delivery order.

The use of the authority cited below:

[X] AMC 4. Acquire, for the first time, directly from the manufacturer.

The use of the authority cited is based on:

[X] AMSC Q. The Government does not have adequate data, lacks rights to data, or both needed to purchase this part from additional sources. The Government has been unable to economically buy the data or rights to the data, although the part has been undergoing full screening for 12 or more months. Breakout to competition has not been achieved, but current, continuing actions to obtain necessary rights to data or adequate, re-procurement technical data indicate breakout to competition is expected to be achieved. This part may be a candidate for reverse engineering or other techniques to obtain technical data. All AMSC Q items are required to be reviewed within the timeframes cited in 2-203(b). If one source is available, AMCs 3, 4, or 5 are valid. If at least two sources exist, AMCs 1 or 2 are valid.

6. Efforts to ensure that offers are solicited from as many sources as practicable are:

[X] The synopsis was posted FBO on July 15, 2019, with a closing date of July, 30, 2019.

[ ] Manufacturers of similar products identified in the market research will be solicited.

[ ] Dealers of the manufacturers will be solicited.

[ ] A synopsis exception cited in FAR 5.202(13) applies. (explain) [X] Other: An additional Source Sought Announcement (SSA) was issued on February 13, 2019.

7. Market Research/Efforts to Obtain Competition:

An SSA was issued on February 13, 2019, with a closing date of February 20, 2019, by DLA Land Aberdeen which resulted in no response. One source, Mnemonics, Inc. (CAGE 6R026), submitted a Statement of Capability (SOC) at the request of the U.S. Government on June 6, 2019. The Government found Mnemomics to be non-responsive on several inquiries, but understood Mnemonics would have the opportunity to fully address its capability in its response to the Request for Proposal (RFP). Even if Mnemonics was determined to have the capability to produce a like item, the Government does not own the Technical Data Package (TDP) for this requirement and it would take at least nine (9) months to reverse engineer this item. It has not been determined whether Mnemonics would be willing to attempt to develop an item that would duplicate the capabilities of the Honeywell INU. What has been determined is that it would be cost-prohibitive for the Government to pay for such development. Another potential source, Microwave Applications Group, Inc., CAGE 26357, was contacted but they failed to submit an SOC and were therefore determined to be non-responsive. There is no competition anticipated for this acquisition.
