Identify end item, weapon system, or class of item:
The weapon system is the Army/Navy Piloted Aircraft/Visual and Visible Light/Receiving, Passive Detecting (AN/AVR-2B (V)) Laser Detecting Set (LDS). The AN/AVR-2B (V) LDS system is a laser warning system that informs and assists U.S. Army aircrews in the detection and verification of impending threats from laser aided weapon systems, including Surface-to-Air Missiles, Air-to-Air Missiles, Anti-Aircraft Artillery, and small-arms weapon systems. The AN/AVR-2B (V) LDS system is designed to work through its interface with the AN/APR-39A Radar Signal Detecting Set on the aircraft’s Multi-Function Display unit. The AN/AVR-2B (V) LDS is an improved version of the AN/AVR-2A (V) LDS, the previous generation system, and is backward compatible with the AN/AVR-2A (V) LDS.

4. The statutory authority permitting other than full and open competition is:
[X] 10 U.S.C. 2304(c)(1) - Available from only one or a limited number of sources.
Brief narrative supporting the situation and weapon system:
This Justification and Approval supports a solicitation using other than full and open competition procedures for a four-year, Firm-Fixed-Price (FFP), Indefinite-Delivery, Indefinite-Quantity
(IDIQ) supply contract to procure the eleven parts listed above. The Government requires spare parts that are form, fit, and functionally compatible with the sensor unit assembly and signal comparator modules, part of the AN/AVR-2B (V) LDS system, The Government does not currently possess the detailed technical data that describes all required form, fit, and function characteristics of these parts
Goodrich Corporation, (Goodrich), CAGE 8F963, the Original Equipment Manufacturer (OEM), located at 100 Wooster Heights, Danbury, CT, is the only known manufacturer of the AN/AVR- 2B (V) LDS system. Goodrich controls the technical data necessary to produce spare parts that are compatible with this system and is therefore the only known manufacturer with the comprehensive knowledge and expertise to produce these required items. On November 2, 2018, the Contract Specialist asked Goodrich if they were interested in selling the Technical Data Package for the system. Gregory Beach stated that Goodrich does not intend to sell and will not consider selling the TDP. The CECOM Engineer estimates that a reverse engineering effort would take three to five years and cost between $2 to $3 million dollars.
5.
The use of the authority cited below:
[X ] AMC 3. Acquire, for the second or subsequent time, directly from the manufacturer.
[X] AMC 4. Acquire, for the first time, directly from the manufacturer.
The use of the authority cited is based on:
[X] AMSC R. The Government does not own the data or the rights to the data needed to purchase this part from additional sources. It has been determined to be uneconomical to buy the data or rights to the data. It is uneconomical to reverse engineer the part. This code is used when the Government did not initially purchase the data and/or rights. If only one source has the rights or data to manufacture this item, AMCs 3, 4, or 5 are valid. If two or more sources have the rights or data to manufacture this item, AMCs 1 or 2 are valid.
6. Efforts to ensure that offers are solicited from as many sources as practicable are:
[X] The acquisition was synopsized on Federal Business Opportunities on December 3, 2018.
The standards set forth at FAR 5.207(c)(16)(ii) were included in the synopsis to instruct interested sources on establishing capability.
7. The Contracting Officer: I hereby determine that the anticipated cost to the Government will be fair and reasonable based on cost analysis of certified cost and pricing data pursuant to FAR 15.403-4 and price analysis.
8. Market Research/Efforts to Obtain Competition:
In accordance with FAR Part 10, market research has been ongoing for these parts. Prior market research for the AN/AVR-2B (V) LDS spares was conducted in 2017 by the CECOM Engineer and DLA Land at Aberdeen. The market research consisted of phone calls, posting to FBO, emails, and searching the following databases: WebFLIS, Army i2Log, Federal Procurement Data System (FPDS), ILS Mart, and the internet. The last procurement of these parts was on contract SPRBL1-19-D-0001 awarded to Goodrich on a 1-year IDIQ expiring on 12 August 2019.
Since that contract was awarded, the CECOM Engineer and DLA Land at Aberdeen have continued to conduct market research to determine if there are additional sources to supply the components for the AN/AVR-2B (V) LDS. The Contract Specialist conducted searches as stated above, to determine if any other manufacturing sources became available since the extensive market research was done in 2017. A search of all eleven parts showed that Goodrich is the only known manufacturer and supplier of these NSNs. The research conducted showed that parts for this system were being tracked from as early as 2003 and Goodrich has always been the only approved source. In a phone call with Goodrich on December 11, 2018, Gregory Beach, the Contract Manager, stated they will be submitting a proposal for this acquisition. A Sources Sought Announcement was posted to Federal Business Opportunities (FBO) on December 12, 2018. No response was received to this posting.
On November 29, 2018, informed the DLA Contracting Office that Rockwell Collins acquired Goodrich on November 27, 2018. While the letterhead will change to Collins Aerospace, ISR & Space Solutions, Danbury; Mission Systems, the company will retain CAGE Code and name Goodrich Cooperation in System for Award Management (SAM). The SAM registration is active until May 11, 2019.
Market Survey [10 U.S.C. 2304(f)(3)(D)]:
