FOR OFFICIAL USE ONLY
JUSTIFICATION AND APPROVAL
FOR OTHER THAN FULL AND OPEN COMPETITION
SPRBL1-19-R-0018
1. Contracting Activity: Defense Logistics Agency (DLA) DLA Land at Aberdeen (DSCC-ZLAA) 6565 Surveillance Loop, Bldg. 6001, Rm C1-301 Aberdeen Proving Ground, MD 21005-1846
2. Description of Action
This Justification and Approval supports a solicitation using other than full and open competition procedures for five (5) year long-term, Firm Fixed Price (FFP), Indefinite Delivery Indefinite Quantity (IDIQ) contract(s) for 160 NSNs that support the Warfighter Information Network-Tactical Increment 1 (WIN-T INC 1) system. The WIN-T INC 1 system is one system that is included in the overall WIN-T program.
These NSNs are manufactured by various commercial sources, and were determined to be commercial by the Contracting Officer on November 01, 2018. FAR Part 12 and FAR Part 15 procedures will be used to procure these NSNs. Many of these NSNs are available from a limited number of sources including the Original Equipment Manufacturer (OEM), and the WIN-T system developer and integrator, General Dynamics Mission Systems (CAGE Code 67032). Other parts are available by only by the OEM. Some of the OEMs that manufacture these parts include: Eaton Corp (CAGE Code 70513), Datapath Inc. (CAGE Code 1BPK0), HDT Expeditionary Systems Inc. (CAGE Code 0WJE1), Renaissance Electronics & Communications, LLC (CAGE Code 30QK4), Communications & Power Industries, LLC (CAGE Codes 03ZJ4, 06980, and 04GH1), Comtech Corp. (CAGE Code 1RN38), Crosspoint Technologies, Inc. (CAGE Code 3XJY8), and Viasat, Inc. (CAGE Code 1Q601). Further detail on the parts are described in Section 3, Description of Supplies/Services.
3. Description of Supplies/Services
The Warfighter Information Network-Tactical (WIN-T) is an extensive tailorable suite of integrated tactical network communication with network/cyber management capabilities to support the Army’s complex, Joint, Coalition, and Civil missions worldwide. WIN-T is a tactical communications backbone that enables mission command and secure reliable voice, video, and data communications. WIN-T is composed of four systems: WIN-T Increment 1 (WIN-T INC 1), WIN-T Increment 2 (WIN-T INC 2), Tactical Cyber and Network Operations, and Satellite Communications.
The NSNs included on this acquisition support the WIN-T INC 1 system. WIN-T INC 1 establishes a network backbone that provides the full range of data, voice, and video communications to battalion and above echelons using satellite and line-of sight at-the-halt (static) communications nodes. Recent upgrades to WIN-T added Network Centric Waveform Capability (NCW), which is a dynamic waveform that optimizes bandwidth and satellite utilization. A key attribute of NCW is that it facilities communication between at-the-halt (static) WIN-T INC 1 and on-the-move (dynamic) WIN-T INC 2 systems. The listed NSNs use either commercial or commercial-off-the-shelf (COTS) capability and are configured to be operable within the WIN-T INC 1 system.
The 160 NSNs are shown in Attachment 1 - NSN List for Procurement/Manufacture. The estimated values are as follows:
6. Efforts to Obtain Competition
Efforts to obtain competition will be accomplished through ongoing market research. Current market research details are in Section 8, Market Research. In accordance with FAR 5.201, this action will be synopsized in FedBizOpps at least 15 days prior to issuance of the solicitation.
7. Fair and Reasonable Cost Determination
As the Contracting Officer, I hereby determine that the anticipated price to the Government for this contract action will be fair and reasonable. These items are commercial, and certified cost or pricing data is not required. However, data other than certified cost and pricing data will be obtained as needed to support a fair and reasonable price determination.
8. Market Research
The Army Integrated Logistics Support Center (ILSC) and with coordination with DLA posted a Sources Sought Announcement (SSA) on February 13, 2017, including all NSNs and one competitive NSN that was later removed from this procurement action. It should be noted that this procurement action initially included remanufactured NSNs as a requirement. However, later market research indicated that many remanufactured NSNs could not be reasonably priced, and therefore, it was removed from the requirement. The Government received three responses to the SSA. GDMS responded that they were interested and the Government Technical Expert advised they were fully technically capable on March 7, 2017. Nexagen Networks (Nexagen), a small business, responded that they were interested. Their submitted capability statement indicated that they were awarded the WIN-T INC 1 sustainment, maintenance, and repair and reset tasks on Unit Hub Baseband SATCOM Truck, SST, Commercial Tactical Hub, Joint Network Node/Single Shelter Switch, and Battalion Command Post Node. Nexagen did not state specifically how they would support all the NSNs, including those that they were not required to provide on the above contract. The Army Technical Expert advised that Nexagen was possibly capable to perform. Renaissance Electronics and Communications (Renaissance) responded that they were interested and the Army Technical Expert advised that they were the OEM for one NSN.
As a follow-up to the original SSA, and as a precaution since the information was over a year old, DLA posted a SSA on May 9, 2018, and included a response date of June 9, 2018. One company, Communications & Power Industries (CPI) responded indicating interest in supplying and remanufacturing some of its company’s parts. CPI is an OEM for six (6) NSNs included on this procurement action. However, once the Contract Specialist requested additional information from the company, it stated “In the case of the WIN-T program, for which the products noted apply to, CPI would prefer to continue to support the program by providing the spares and/or replacements to the Army through the OEM of the WIN-T Systems as we have already established a well-coordinated working relationship.”
The Contract Specialist also performed additional market research from April 20, 2018 through October 25, 2018, for the purposes of finding additional and willing sources. As part of this research, the DLA Contract Specialist emailed market surveys to all active companies that had a primary or secondary part number. Out of the thirteen (13) surveys sent, only two companies responded indicating interest to supply some of these parts. The two companies were Wavestream and Comtech EF Data. The Contract Specialist did not find any other sources or distributors for the WIN-T-INC 1 NSNs.
On November 7, 2018, the Contract Specialist publicized on FedBizOpps.gov a draft Request for Proposal (RFP) with a response date of November 26, 2018. Only one company, Wavestream, responded with interest in supplying one of the 160 NSNs.
9. Other Facts
The previous procurement history for the WIN-T INC parts and remanufactured parts is shown in the table below.
Contract Number Award Date Contractor Scope Extent Competed/Authority
W15P7T-07-D-K001 Sept. 28, 2007 General Dynamics C4 Systems, Inc.
WIN-T Inc. 1 Integration – Initial Development and Production
Full and Open Competition
W15P7T-15-D-0014 Apr 21 2015 General Dynamics C4 Systems, Inc. New & Remanufactured Parts Full and Open Competition
The Army contracts listed above were procured using competition, with the intent that one prime contractor was to provide overall product support integration across the entire program as the WIN-T INC 1 system entered the sustainment phase. In reference to W15P7T-15-D-0014, of the three proposals received, only one was determined to be technically acceptable, per advisement of the Army Contracting Command – Aberdeen Proving Ground (ACC-APG) Branch F Chief on June 8, 2017. General Dynamics C4 Systems, Inc., CAGE 67032, 400 John Quincy Adams Road, Taunton, MA 02780-1036 was awarded the contract.
10. Interested Sources
Nexagen, GDMS, Renaissance, Wavestream and Comtech EF Data have expressed an interest in supplying some or all of the parts included in this solicitation. CPI withdrew its interest. Nexagen would act as a supplier, while the other companies are OEMs. Although the solicitation will provide for submission of alternate part offers, Nexagen would have to coordinate and provide the exact OEM part number. See section 8 Market Research above for further details.
11. Actions to Increase Competition
There is no previous J&A because the previous contract action was solicited to allow full and open competition. The solicitation will be evaluated on a CLIN by CLIN basis to encourage companies to respond to the solicitation. It is expected that there will be awards to more than one contractor.
Additionally, the Government will continue to conduct market research to ascertain if changes occur in the marketplace that would enable future actions for these items to be competitive.
12. Certifications (continued)
I have reviewed and approve this justification.
