7. Fair and Reasonable Cost Determination:

Per FAR 15.404-1(b), price analysis will be used to evaluate pricing. These items were determined commercial on January 8, 2019. Per FAR 15.403-1(b)(3), the commerciality of the items subject of this procurement make them exempt from the requirement for certified cost or pricing data. Comparison to historical pricing of same or similar items, data other than certified cost or pricing data (if necessary), and any other means allowed by regulation, will serve as the basis for determining that the proposed pricing is fair and reasonable.

8. Market Research/Efforts to Obtain Competition:

A SSA was posted on FedBizOpps from November 17, 2017, to December 4, 2017, by the U.S. Army Communications and Electronics Command (CECOM). The SSA listed 93 NSNs, and discussed the requirement for both new procurement and remanufacture of the items, along with obsolescence monitoring and resolution.

Two vendors responded to the SSA on December 4, 2017: General Dynamics Mission Systems (GDMS) (CAGE 67032) and Datapath (CAGE 1BPK0). GDMS is a large business and the prime contractor of the WIN-T INC 2 system. Datapath is a large business and an OEM for some of the NSNs included on the SSA.

Due to the age of the previous market research and the determination that a separate acquisition for these twelve

(12) NSNs manufactured by ASC Signal Corporation would be sought, the Contracting Officer (KO) posted another SSA on August 14, 2018, which closed on August 22, 2018. No response was received to the SSA. The Contract Specialist (KS) checked these NSNs in WebFLIS which assigned an RNCC/RNVC of 3/2 to ASC Signal Corporation as the OEM for these NSNs. On August 16, 2018, the KS contacted the OEM, and they confirmed their interest in and capability of supplying these NSNs to the Government. On September 14, 2018, the KS forwarded a market survey to ASC Signal Corporation, but the vendor did not respond to the market survey.

The solicitation SPRBL1-19-R-0002 was posted on the Federal Business Opportunities (FedBizOpps) website from February 1, 2019, to March 4, 2019, but ASC Signal did not submit a proposal. On March 15, 2019, the company informed the KS that it was not willing to enter into a 5-year IDIQ contract with the Government. On March 19, 2019, the KS contacted Datapath and GDMS to see if they are able to provide these parts to the Government. On March 25, 2019, Datapath (CAGE 1BPK0) notified the KS that they are able to supply nine (9) of the NSNs (-1054, -4868, -4368, -4313, -4377, -4408, -4425, -0018, and -0530). Datapath is a large business and is a distributor of ASC Signal. On April 11, 2019, the KS informed the customer of this information, who in turn requested provisioning to add Datapath CAGE and part numbers as a secondary source for these 9 NSNs. GDMS notified the KS on April 1, 2019, that they are unable to provide any of the NSNs. On May 13, 2019, Datapath submitted a proposal for all 12 NSNs in response to the solicitation.

The KS conducted additional market research by performing an internet search of the products and the WIN-T INC2 system and querying WebFLIS and Haystack to determine if other sources were available. There were no additional vendors found during the extensive market research other than ASC Signal Corporation and Datapath.

Per FAR 6.302-1, ASC Signal Corporation is the only company capable of manufacturing these items.
