SOURCE SELECTION INFORMATION & SENSITIVE – SEE FAR 2.101 & 3.104

FOR OFFICIAL USE ONLY – PAGE 2

The contractual values are summarized below:

Estimated Annual Value:

Estimated Five-Year Value:

Estimated Maximum Five-Year Value:

Guaranteed Minimum:

These items except CLIN 5 are designated in the Federal Logistics Information System (FLIS) with an Acquisition Method Reason Code of 3/R. An AMC code of “3” signifies items being acquired, for the second or subsequent time, directly from the actual manufacturer, while an AMSC code of “R” signifies the Government does not own the data or the rights to the data needed to purchase this part form additional sources. It has been determined to be uneconomical to buy the data or rights to the data. It is uneconomical to reverse engineer this part. CLIN 5 is in the process of being changed from “3H” to “3R” by CECOM provisioning;

however, all cognizant systems do not immediately reflect this change.

Per DLAD 6.302-2(a)(S-90)(i), (A) Items identified by AMSC A or H on long term contracts are subject to review for possible assignment of a different or permanent AMSC. These items shall be continually reviewed, not less than annually, in part to determine if technical data is available to allow for assignment of a more permanent AMSC. Any item determined to be competitively available before contract award will be removed from the acquisition. Any item determined to be competitively available after contract award may be deleted from the contract and competitively re-solicited. (B) The results of the reviews and reclassification actions for AMSC A and H items will be reported by the contracting officer to the local competition advocate, and may be reported to DLA Competition Advocate in accordance with DLA Acquisition requirements. (C) If the review of an item classified as AMSC H does not result in the assignment of a more permanent AMSC within the later of one year of approval of this justification or one year of the item’s placement on a contract covered by this justification, the contracting officer shall remove the item from the contract.

4. Authority Cited: 10 U.S.C. 2304(c)(1) and FAR 6.302-1(a), Only one responsible source and no other supplies or services will satisfy agency requirements.

5. Reason for Authority Cited: The spares and components subject of this requirement are available from only one or a limited number of sources; therefore, DLA Land at Aberdeen intends to issue the solicitation using other than full and open competition under FAR 6.302- 1(a)(2), which provides When the supplies or services required by the agency are available from only one responsible source, or for DoD, NASA, and the Coast Guard, from only one or a limited number of responsible sources, and no other type of supplies or services will satisfy agency requirements, full and open competition need not be provided for.

Honeywell is the sole developer, integrator, and Original Equipment Manufacturer (OEM) of the AN/APN-209(V) family of Radar Altimeters and the only source that has the technical data and expertise to produce the spares and components. The receiver transmitter (RT) is comprised of several circuit card assemblies and a radio frequency (RF) module solely produced by Honeywell. The RF module was redesigned due to obsolete parts and the front glass display was

FOR OFFICIAL USE ONLY – PAGE 3

also redesigned with an Indium Tin Oxide compound for better Electro Magnetic Interference (EMI) protections. The implementations of these redesigns are proprietary to Honeywell.

Additionally, the items subject of this acquisition, are not defined by any nationally recognized industry standard or specification. Honeywell is the only source that has produced and supplied the required spares and components.

The Government does not possess detailed drawings/specifications for the AN/APN-209(V) or its spares and components, and has made various inquiries of Honeywell to assess their interest in selling the Technical Data Package (TDP). The latest inquiry was made via email by the Contracting Officer on 8 July 2014, to which Honeywell responded negatively on the same date.

All prior inquiries also resulted in a negative response, as per Honeywell, the TDP for the AN/APN-209(V) is considered a long-term strategic asset. Currently, there are no known non-developmental and/or commercial equivalents for the AN/APN-209(V) Radar Altimeter Set or its spares and components, that can be modified to meet the Government’s requirement. These spares and components are required for the AN/APN-209(V) to be operable. Inoperability of the AN/APN-209(V) would result in the grounding of aircraft, adversely affecting mission capabilities, and thereby increasing the risk of serious injury or loss of life to warfighters.

6. Efforts to Obtain Competition: Efforts to obtain competition will be accomplished through ongoing market research. Current market research is provided in Section 8 below.

7. Fair and Reasonable Cost Determination: As the Contracting Officer, I hereby determine that the anticipated price to the Government for this contract action will be fair and reasonable.

Certified cost and pricing data will be obtained as necessary for these items.

8. Market Research: On 28 August 2013, technical experts within the Communications- Electronics Research Development and Engineering Center, Product Realization Directorate (CERDEC PRD), published a Sources Sought Announcement (SSA) on the Federal Business Opportunities (FedBizOpps) website seeking potential sources for the manufacturing of four of the required components. No responses were received by the response date of 30 September 2013; however, Honeywell expressed interest in writing on 4 November 2013, and also confirmed that they remain the sole source provider of the items included in the SSA. The only other response was from Axis Aerotech, Inc., expressing interest in a repair contract, which was not relevant for this acquisition. The fifth NSN, 1680-01-617-6902, was added to the acquisition on 19 May 2014. This NSN is a newer version of NSN 5841-01-421-4161.

The Contracting Officer conducted independent market research via a Federal Logistics Information System Web (WEBFLIS) inquiry and Haystack Gold logistics information system, on all five NSNs to determine whether alternate viable sources existed for any of the required components and no additional sources were identified. The requirement was synopsized on FedBizOpps on 30 May 2014, to which Honeywell responded on 3 June 2014 expressing interest in the requirement. Telectronik, LLC, a self-proclaimed “small business dealer/distributor” also responded on 11 June 2014, expressing interest in supplying NSN 5841-01-581-9338 (CLIN 4).

Because there are no small business manufacturers of the required components, no portion of this requirement will be set aside for small business.

b. Acquisition Data Availability: The Government only possesses a Statement of Work that defines the Form, Fit and Function (F3) requirements for the AN/APN-209(V) Radar Altimeter Set. The Government does not own the requisite technical data, and only possesses a part number and cage code for the items subject of this acquisition. All technical data for the AN/APN-209(V) and its components is proprietary to Honeywell.

10. Actions to Increase Competition: The solicitation and resultant contract(s) will include subcontracting opportunities. A small business subcontracting plan will be required per FAR 52.219-9 and DFARS 252.219-7003. FAR 52.244-5, Competition in Subcontracting, will be included and requires a contractor to select subcontractor and suppliers on a competitive basis to the maximum extent possible.

The Government will continue to conduct market research to ascertain if there are changes in the marketplace that would enable future actions for these items to be competed among a greater number of suppliers. If competition is determined to be viable, a competitive acquisition will be initiated and upon award the competitively awarded contract will be used to meet the Government’s requirements. It is anticipated, however, that future acquisitions will need to be awarded on a sole source basis.

Evaluation and award will be made on a CLIN by CLIN basis. While the actual level of competition expected is uncertain, this solicitation may result in more than one contract resulting from this CLIN by CLIN evaluation. Lastly, DLAD 52.217-9002 (see Paragraph 8 above) will be included in the solicitation.
