DEFENSE LOGISTICS AGENCY
JUSTIFICATION FOR OTHER THAN
FULL AND OPEN COMPETITION
1. Contracting Activity: DLA Land at Aberdeen Attn: DSCC-ZLAA 6001 Combat Drive, Room C1-301 Aberdeen Proving Ground, Maryland 21005
2. Description of Action: This Justification and Approval supports a procurement using other than full and open competition procedures for a one-time, Firm-Fixed-Price (FFP) supply contract with Sikorsky Aircraft Corporation (Sikorsky), CAGE Code 78286. This requirement is for the production and delivery of one National Stock Number (NSN). At the time of solicitation, the estimated maximum dollar value fell below the Simplified Acquisition Threshold (SAT) of $150,000. Because the Government’s demands relative to quantity were nominal, the strategy for this acquisition was to use the procedures outlined in FAR Part 13, Simplified Acquisition Procedures. The solicitation was posted on November 23, 2012 and closed on December 7, 2012. Amendment 0001 was issued removing the Statement of Work, (SOW), and Reverse Auction (R/A)clause. After numerous inquiries, and command elevation, Sikorsky submitted a quote on May 28, 2013; they were the only offeror to submit a quote. Sikorsky’s reason for the delay in response was due to securing new sources to build and furnish the Navigation Interface Unit (NIU).
Because Sikorsky’s quote is above the SAT, FAR Part 15 “Contracting by Negotiation” procedures will be used for this procurement.
3. Description of Supplies/Services: NSN 5895-01-579-8451, Navigation Interface Unit (NIU) is being procured in support of the HH-60L Medevac Black Hawks. The NIU is unique to the HH- 60L helicopter fleet, of which there are 34 airframes in service. The HH-60L is a transition aircraft, utilizing older analog avionics with a digital cockpit interface, after the fielding of the all-analog UH-60L and prior development of the fully digital UH-60M generation of helicopters.
The NIU is comprised of several relays and a few simple circuit card assemblies to translate data between the analog navigation equipment and the digital cockpit displays used by the pilots.

4. Authority Cited: The statutory authority permitting other than full and open competition is 10 U.S.C. 2304(c) (1), as implemented by FAR 6.302-1, "Only One Responsible Source and no other supplies or services will satisfy requirements."
5. Reason for Authority Cited: The only currently approved source is Sikorsky Aircraft Corporation, Cage Code78286, 6900 Main Street, Stratford, CT, 06614-1385. The NIU is unique to the HH-60L helicopter fleet, of which there are 34 airframes in service. The HH-60L was a transition aircraft, utilizing older analog avionics with a digital cockpit interface, after the fielding of the all-analog UH-60L and prior to the development of the fully digital UH-60M generation of helicopters. The NIU is comprised of several relays and a few simple circuit card assemblies to translate between the analog navigation equipment and the digital cockpit displays used by the pilots. Although the Government owns technical data that details the NIU exterior shell, the Government does not possess detailed drawings for the circuit cards contained within.
6. Efforts to Obtain Competition: Market research was conducted, details of which are in the market research section of this document. This effort did not yield any additional potential sources that can meet the Governments requirement. There is no competition anticipated for this acquisition.
7. Actions to Increase Competition: As the Contracting Officer, I hereby determine that the anticipated price to the Government for this contract action will be fair, and reasonable based on price analysis and comparison of proposed prices with an Independent Government Estimate.
8. Market Research: On 3 June 2011, technical experts from the LRC published a Sources Sought Announcement (SSA) on the FedBizOpps Page to determine whether any other source could meet the Government’s requirements. There were no responses received; however, Sikorsky stated they were interested via email on 31 August 2011. Additionally, the Contract Specialist has conducted internet searches on an ongoing basis, and no additional sources have been identified.
9. Interested Sources: FAR 5.202 contains the exceptions to synopsizing proposed contract actions. FAR 5.202 (a)(13) states a proposed contract action does not need to by synopsized if the proposed action “(i) is for an amount not expected to exceed the SAT, (ii) will be made through means that provides access to the notice of proposed action through the GPE (Government Point of Entry), and (iii) permits the public to respond to the solicitation electronically. As stated previously, the anticipated maximum dollar value for this procurement, prior to solicitation fell below the SAT. Therefore, a synopsis of this proposed contract action was not posted on FedBizOpss. The solicitation was posted on FedBizOpps, which is the GPE.
In the FedBizOpps solicitation notice, interested parties were directed to the Army Single Face to Industry (ASFI) website, where interested parties could respond electronically. Because the solicitation was posted on FedBizOpps, other possible interested sources had the opportunity to express interest or capability in providing the part. No other parties other than Sikorsky submitted a proposal in response to the solicitation.
