JUSTIFICATION AND APPROVAL

FOR OTHER THAN FULL AND OPEN COMPETITION

SPRBL1-13-R-0025

1. Contracting Activity: DLA Land Aberdeen 6001 Combat Drive, Room C1-301

APG, MD 21005-1846

2. Description of Action: This proposed action is for a solicitation using other than full and open competition for spare parts manufactured by DRS Tactical Systems (DRS); Commercial and Government Entity (CAGE) code 1RWE7. The solicitation is contemplated for a one time, firm-fixed-price spot buy contract for spare parts for the Force Twenty-One Battle Command, Brigade and Below (FBCB2) family of systems, also identified as AN/UYK 128(V). Army Working Capital Funds (AWCF) will be used in this effort. It is estimated that the contract maximum will be Logistic Readiness Command (LRC) Command, Control, Communications, Tactical (C3T) Directorate at Aberdeen Proving Ground is the requiring activity for this contemplated action and DLA Land at Aberdeen is the contracting activity and will use FAR Part 15, Contracting by Negotiation, procedures.

3. Description of Supplies: The part being purchased in this acquisition is a Disk Drive Unit, NSN: 7025-01-598-1552, DRS Part Number 9800-13900-0320. It is estimated that two thousand (2,000) each of this part will be purchased in this acquisition. The Army has assigned this NSN an essentiality code of “A”, identifying this part as essential. Essential NSNs are defined by the Army as parts that accomplish one of the following:

Furthermore, this NSN has a maintenance identifier of “C”, which means failure of this part will render the end item inoperable.

The FBCB2 System is Army’s digital battle command information system at the Brigade and Below. It provides an integrated, on-the-move, real-time/near real-time Situational Awareness (SA) and Command and Control (C2) information to all tactical combat, combat support, and

For Official Use Only Source Selection Sensitive Information Page 2 See FAR 2.101 and 3.104 combat service support commanders, leaders, and solders across the force. The FBCB2 is a key component of the Army Battle Command System (ABCS) and interfaces with the Ground Command and Control System (GCCS) found in battalion and brigade Tactical Operation Centers. The FBCB2 consists of the V4 Applique computer system, software and installation kits. The installation kits allow use in various tactical vehicles.

Since November 2002, FBCB2 Systems have been used by U.S. Army Forces participating in Operation Enduring Freedom (OEF) and Operation Iraqi Freedom (OIF). Currently, FBCB2 is being used in support of the United Nations Mission of Peace activities in Afghanistan.

4. Authority Cited: The applicable statutory authority permitting other than full and open competition is 10 U.S.C. 2304(c)(1), as implemented by FAR 6.302-1, “Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.”

5. Reason for Authority Cited: The source for this action is DRS Tactical Systems, Inc.. This contractor is the only source with detailed knowledge of supplying the Line Repairable Units (LRUs) used in the FBCB2 System. The C3T engineering staff has coded the NSN being acquired “3H” using the acquisition method code/acquisition method suffix code (AMC/AMSC) system referenced in Department of Defense Procurement, Guidance, and Information (PGI) 217.7506 part 2. An AMC of “3” represents that the parts should be acquired for the subsequent time from the actual manufacturer. An AMSC of “H” means the Government physically does not have in its possession sufficient, accurate, or legible data to purchase this part from other than the current source.

The NSN must be compatible with existing FBCB2 systems, meet extreme environmental conditions, contain nuclear, biological and chemical protection, and satisfy electromagnetic interference requirements as described in both technical specifications FBCB2-JV5-0001 and FBCB2-JPT-0001. Additionally, since the FBCB2 program commenced fielding in 2001, there are now over 42 platform variants. This results in a considerable effort with regard to logistics support and resultant need to not deviate from the present confirmation of the individual LRSs from a compatibility standpoint. Thus, compatibility and interoperability of the LRUs in this applicable is vital.

The Government does not possess detailed technical on the proprietary, internal designs of the system and corresponding spare parts manufactured by DRS. Additionally, the Government requires LRUs that are form, fit, and functionality interchangeable with those previously acquired to ensure installation and operation on the vehicular platforms using FBCB2 System.

6. Efforts to Obtain Competition: Technical experts from the Army’s Logistics Readiness Command issued a sources sought announcement on FedBizOpps for the spare part acquisition on 30 June 2011, which required interest sources to express interest by 25 July 2011 with a supplier response date of 13 September 2011.

Two responses were received; one from the existing manufacturer and from Smartronix, Hollwood, MD. A summary of Smartronix response is stated in the Market Research section below.

In accordance with FAR 5.201, the proposed contracting action will be synopsized at least 15 days prior to the issuance of the solicitation. In addition, the provision 52.217-9002 (Dec 2011), Conditions for Evaluation and Acceptance of Offers for Part Numbered Items, will be included in the solicitation. This provision will identify the necessary requirements to supply another part. The Government will also continue to conduct market research to determine alternative sources for FBCB2 spare parts.

7. Fair and Reasonable Cost: As the Contracting Officer, I hereby determine that the anticipated price to the Government for this contract action will be fair and reasonable based on price analysis. Certified cost and pricing data will not be obtained for these items in accordance with FAR 15.403-4(a)(1).

8. Market Research: In response to the sources sought announcement outlined in section 6 of this document, the Logistics Readiness Command received an e-mail response from DRS and Smartronix on 25 July 2011. Smartronix

9. Other Facts:

a. Availability of Data: DRS Tactical Systems is the only supplier that possesses the technical data package for these parts and the Government only possesses a performance-based statement of work and a performance-based specification for the overall FBCB2 System.

DRS Tactical Systems is not willing to provide the technical data package to the Federal Government for the purposes of issuing competitive acquisitions.

10. Interested Sources: DRS Tactical Systems and Smartronix expressed interest in this acquisition.

Only DRS Tactical Systems owns the technical data packages for this NSN that is qualified on the FBCB2 family of systems.
