4. The statutory authority permitting other than full and open competition is:
[X] 10 U.S.C. 3204(a)(1) - Available from only one or a limited number of sources.
Vendor for this procurement MUST use a source from the NAVSEA S9320-AM-PRO-20 list for molding.
Brief narrative supporting the situation and weapon system:
The AN/BQQ-10 SONAR system uses a variety of sensors to search the ocean to detect, track, classify, and localize acoustic threats and targets. During SSN-784 EDSRA-01, the power cables to the passive side on the LAB array hydrophones require replacement. The National Stock System dates do not support EDSRA- 01 schedule.
5. If restricted to the only source(s) of supply, include source(s) and CAGE code:
On 11/21/2023 Alex Lebrato, Code 290 Engineer, certified that the technical information , including the AMS/AMSC code and approved source was complete and accurate.

The use of the authority cited below:
[ X ] AMC 4. Acquire, for the first time, directly from the manufacturer.
[ X ] AMSC N. Manufacture of this part requires special test and/or inspection facilities to determine and maintain ultra-precision quality for its function or system integrity. Substantiation and inspection of the precision or quality cannot be accomplished without such specialized test or inspection facilities. If the test cannot be made available for the competitive manufacture of the part, the required test or inspection knowledge cannot be documented for reliable replication, or the required physical test or inspection facilities and processes cannot be economically documented in a TDP, valid AMCs are 3, 4, or 5. If the facilities or tests can be made available to two or more competitive sources, AMCs 1 or 2 are valid.
6. Efforts to ensure that offers are solicited from as many sources as practicable are:
[X] The acquisition was synopsized on or about __12/15/2023 .
[X] Other. (Explain): __The solicitation will be solicited on SAM.gov to encourage potential supplier participation. The solicitation will be posted for a reasonable amount of time, in consideration of the estimated material lead time, and Government’s material need date. The Government will continue to conduct market research to see if changes occur in the marketplace that would enable future actions for these items to be competitive. A sources sought was posted for this requirement, additional details can be found in paragraph 8.
7. I hereby determine that the anticipated cost to the Government will be fair and reasonable.
SOLICITATION SPMYM3-24-Q-5012
DLA Land & Maritime Justification for Other Than Full & Open Competition
In accordance with FAR 13.106-3 and 15.404, the Procuring Contracting Officer will make a determination of fair and reasonable pricing prior to award. Determination to establish price reasonableness will be made based upon comparison of the proposed price with prices found fair and reasonable on previous contracts, as well as information from market research and other price analysis techniques, such as Producer Price Index Industry (PPI) Data, if necessary. Certified cost and pricing data is not required due to the fact that this requirement is under the threshold (FAR 15.403-4 and 15.403-1(b)(3)), and the Contracting Officer has determined this material to be Commercial (in accordance with FAR 12.103) (See Attached CID).
8. Market Research/Efforts to Obtain Competition:
Describe the market research conducted and the results.
Market Survey [10 U.S.C. 3204(e)(2)(D)]:
[X] A market survey was conducted on/during 10/10/2023 – 10/25/2023 .
A Sources Sought Notice SPMYM324Q5S01was posted on SAM.gov on 10/10/2023, and closed on 10/25/2023, seeking sources capable of providing the required cables. No responses were received from any interested vendors.
Market research determined that this material is considered commercial of a type. These are electrical Cables and although unique to Government applications, there are similar items in the commercial market or a commercial customer could request a similar item be manufactured for them by one of these companies. They are modified by molding them IAW NAVSEA Molding Manual S9320-AM-PRO-020.
Information received regarding the commerciality of the item(s): This procurement is for the purchase of trifurcated electrical cables. Per the item’s drawing, they are essentially electrical cables with a connection on one end but separates three leads with connections on the other. They are manufactured to Government specifications, but electrical cables are also used by industry. Similar cables have previously been purchased under IDIQ contract SPMYM3-22-D-5010 and contract SPMYM321P5059. Similar type cables are available in the commercial marketplace as demonstrated in an Internet search. The cables found in these internet sources are not for shipboard use. This requirement is similar in its function and technology: it is just specialized for submarine work.
9. Additional facts supporting other than full and open competition are:
[X] Based upon the attached technical certification, technical data is not available and cannot be developed to permit full and open competition. The data presently available reflects the minimum needs of the Government.
10. A listing of sources, if any, indicating an interest in the acquisition is: (If none, so state) The sources sought produced no interested vendors. Brantner and Associates (CAGE 15789) was the only source that was contacted during Engineering’s initial research showing interest.
11. The following actions are being taken to identify additional sources:
[X] Solicitation contains DLA Procurement Note, L04 Offers for Part Numbered Items [X] Solicitation contains DLA Procurement Note, M06 Evaluation of Offers for Part Numbered Items
