Justifil .on for Other than Full and Open Cc >etition 10 USC 2304 (c)(2), 6.302-2, Urgency~
Gloves, Leather, Light Duty
1. Defense Logistics Agency (DLA) Troop Support, Clothing and Textiles Supply Chain , Glove and Wet Weather Branch , is the contracting activity.
2. The action being approved is the ability to solicit for DLA requirements on other than full and open competition basis.
3. Following are the supplies required to meet DLA's needs:
Item Description : Gloves, Leather, Light Duty (Product Group Code 03565) National Stock Number (NSN) : 8415-01-566-377 4(s) Quantity: 100,000 pairs Unit Price: $18.00 Estimated Dollar Value: $1 ,800,000.00
4. The statutory authority permitting other than full and open competition is 10 U.S.C 2304 (c)(2) , as implemented by FAR 6.302-2 , Unusual and Compelling Urgency.
5. The use of this authority is necessary because one of the two current contracts for this new item has been terminated for default. Contract SPM1C1-09-D-1058 (60% portion) , awarded on May 5, 2009 to The Glove Corporation , was terminated due to the contractor going out of business and not being able to complete deliveries in the amount of 29,610 pairs. This proposed urgent procurement of 100,000 pairs (includes the defaulted quantity of 29,610 plus the planned orders for the option term) will satisfy the Army's remaining requirements for this bag item until the routine, long-term, follow-on acquisition is awarded and deliveries commence. Award of the follow-on is anticipated by May 2012, with an anticipated first delivery beginning in October 2012.
The first acquisition for this new item was solicited as a 60/40 split on a full and open competition basis with the 60% portion set-aside for small business. Ten firms submitted offers and Product Demonstration Models (PDMs) for evaluation . The names of these firms and the results of their PDM evaluation follow:
e
, " or better PDM rating for this item will be solicited for the urgent requirement. As previously stated, will not be solicited .
Justification and Approval for Other than Full and Open Competition Light Duty Glove, PGC 03565
Following is a summary of the supply position, as of 12/1/11:
There are no known substitute items for the required gloves and, without sufficient stock, the Army will not be able to issue full bags of required supplies to its new recruits starting in April 2012.
The Government anticipates awarding this exigency in December 2011 with delivery commencing 120 days after award (approximately April 2012) and completing 180 days after commencing delivery (approximately September 2012) . Multiple awards will be considered if offered delivery schedules provide product sooner than a single award . '
6. In accordance with FAR 5.202(a)(2), this acquisition will not be synopsized in FedBizOpps. In addition, this justification will be made available for public inspection, after award , in accordance with
FAR 6.305.
7. As the contracting officer, I hereby determine that the anticipated cost to the Government will be fair and reasonable based on adequate competition and a comparison to previous award prices.
8. There are seven (7) known potential sources capable of meeting the Government's requirements : Propper International , Ansell Hawkeye, Hatch Worldwide, Nationwide, Rooster, Sam co and Frontline . These firms will be solicited for this urgent requirement.
9. Without the required gloves, Army recruits will be receiving less than a full bag of required supplies for their initial duty station , negatively affecting morale. A less than full bag constitutes DLA Troop Support mission failure .
10. Propper and Ansell Hawkeye have expressed an interest in this acquisition. In addition to these two firms, Hatch Worldwide, Nationwide, Rooster, Samco and Frontline will also be solicited .
11. The follow-on routine acquisition for the subject light duty gloves will be procured as a small business set-aside and has a target award date of May 2012.
12. As the contracting officer, I hereby certify that this justification is accurate and complete to the best of my knowledge and belief.
