JUSTIFICATION FOR EXCEPTION TO FAIR OPPORUNITY

FOR A MULTIPLE AWARD CONTRACT ORDER (MAC)

>$10,000 but not exceeding the Simplified Acquisition Threshold (SAT)

1. Nature/Description of Contract Action. The service or material listed on N62786-18-F-0029 P00010 is a limited source action to be awarded as a modification of an existing order to the large business identified in paragraph (2) below. The placement of a firm, fixed price order is anticipated.

2. Limited to the following source(s). The proposed acquisition is to increase the number of cellular devices for the command in support of an increased remote work posture to better support waterfront operations. It is intended to acquire additional lines of service under the Government’s existing Task Order for a period of eight months. The current Task Order with AT&T MOBILITY NATIONAL ACCOUNTS, LLC expires on 30 April 2023. The estimated value of this change will be roughly $40K.

3. Identification of the justification rationale. The statutory authority which permits not providing each awardee a fair opportunity to be considered for each order exceeding the micro-purchase issued under a multiple award contract is 10 U.S.C. 2304c, as implemented by FAR 16.505(b)(2). The justification for limiting sources is:

FAR 16.505(b)(2) The order must be issued on a sole-source basis in the interest of economy and efficiency as a logical follow-on to an order already issued under the contract, provided that all awardees were given a fair opportunity to be considered for the original order;

This increase in lines is a logical modification to the Task Order that is already in place with the incumbent. This is in part because a new award would require the establishment of new management controls to ensure that the terms of the contract are followed, likely resulting in substantial duplication of Government effort for an award which would only last eight months. The POP which lasts under one year is due to the sunset of the DON’s current SPIRAL 3 agreements in early 2023 and will require competition of the entire SSBA portfolio of wireless devices under the expected Department of the Navy, Wireless Mobility Services, Blanket Purchase Agreements (DON-WMS BPAs) which are the follow-on vehicles to Spiral 3.

Additionally, this Task Order was issued after adequate competition in April 2018. This modification will be the first time that the authority under this exception has been utilized and will ensure that the requirements of the Government are satisfied in the most economically viable manor by utilizing infrastructure that is already in place for the performance of this Task Order.

4. The SUPSHIP BATH Smart iPhone 11 handhelds are under an AT&T wireless mobility device infrastructure and is fully integrated as a tightly woven fabric under this Wireless Mobility service reflected under one unified SUPERVISOR OF SHIPBUILDING, C&R, USN account. These smart iPhone 11’s and MiFi wireless devices are branded devices. All currently deployed smart handhelds devices operate within the current SUPSHIP Smart Phone Wireless infrastructure enclave.

Maintaining AT&T Mobility Wireless Smart iPhone services has established itself as a successful and proven performance source consistently through AT&T providing the necessary continuity and continuation of established quality of service, advice, analysis and implementation levels. Direct access to technical AT&T Mobile Wireless Smart iPhone experts is required to maximize uptime ensuring performance expectations is securely maintained through a iPhone 11 smart phone. Successful and established vendor support reputation provides the required excellence in delivering not only technical support, the guidance to maintain Handheld networked environment and device oversight during strategic direction of our evolving Flank Speed information technology environment operations.

The Information Assurance Vulnerability Assessment (IAVA) policy requires Department of Defense (DoD) Components to register with the IAVA database and report compliance with IAVA notifications.

The lack of proper software versioning would prevent applying the necessary software patches to comply with IAVA notifications. Network security vulnerabilities should be eliminated to prevent the potential for corresponding network service disruption.

The entire SUPSHIP Bath Information technology (IT) Handheld iPhone infrastructure must be and predicated on continuous uninterrupted end-user operation, with the ability to actively deploy Smart iPhone 11 and MiFi Wireless handhelds within the current IT Smart iPhone enclave. Therefore, it is considered reasonable and necessary to modify N6278618F0029, and add the additional 120 iPhone 11 devices services and accessories to the currently deployed AT&T 157 contracted Smart iPhones to a target of 277 command unified contract totals. Protective accessories’ cases, screen protective sheets and power bricks are designed for the iPhone 11 been provided under current AT&T contract.

5. Provide a description of the market research conducted among schedule holders and the results OR a statement of the reason market research was not conducted. Market research was conducted and involved a review of the SPIRAL 3 IGE calculator which demonstrates that a modification of the existing Task Order allows for utilization of preferable Base Year pricing rather than the higher pricing of the current option year ordering period. The SPIRAL 3 agreement is a mandatory source for cellular devices.

6. Other information to support a limited source buy: This procurement uses a MAC and will be solicited and awarded in accordance with FAR Subpart 16.5.
