Bids shall be submitted, in duplicate, in sealed envelopes upon the blank form of bid proposal furnished. Sealed envelopes shall be clearly marked as follows: 288B Utility Improvements to be opened at 2:00pm on Wednesday, July 1st, 2026.
All blank spaces in the bid form must be filled in, in both words and figures, with amounts extended and totaled. In case of discrepancy between the unit price and the amount bid, the Unit Price written in words shall govern. If the forms contain erasures or other changes, each such erasure or change on bid must be initialed by the signer of the bid. If the bidder does not bid on optional items (if included in the proposal form), “No Bid” shall be entered in the blank spaces provided, therefore. Alternate bids will not be considered unless specifically requested as part of the blank form of bid proposal furnished. Any bid may be deemed irregular and subject to rejection, which contains qualifying or modifying statements, substantial irregularities, or letters accompanying the bid.
Each bid must contain the name of the bidder and the address of the bidder’s place of business or post office address and must be manually signed with the usual signature. Bids by partnerships must contain the full names of all partners and must be signed with the partnership name by one of the partners or by an authorized representative. Bids by corporations must be signed with legal name of the corporation, followed by the name of the state of incorporation and by the signature and designation of the president, vice-president or other person authorized to bind the corporation. Corporation seals must be attached following signatures. Powers of attorney authorizing agents or others to sign proposals must be certified and must be in writing and submitted with the proposal.
All bids shall be accompanied by a cashier’s check, or a certified check drawn upon a National or
State Bank in the amount of 5% of the total bid amount, payable to the City, or a bid bond in the same amount from a reliable surety company, as a guarantee that a bidder will enter into a contract and execute bonds within ten (10) days after Notice of Awards. Bids without a check or bid bond will not be considered.
All bid securities will be returned to the respective bidders within ten (10) days after bid opening, except those of the three low bidders, which the City will hold until the successful bidder has executed the contract and furnished Performance and Payment Bonds. The remaining bidders will receive their bid security within ten days after the execution of the contract and City acceptance of the required bonds.
HDR Job No. 10404407 ITB-2
No sureties will be accepted by the City who are in default or delinquent on any bonds or who are interested in any litigation against the City. All bonds shall be made on forms acceptable to the City and shall be executed by an approved surety company authorized to do business in the State of Texas and acceptable to the City. Each bond shall be executed by the Contractor and the sureties.
The right is reserved as the interest of the City may require, to reject any and all bids, and/or waive any informality in bids received.
A bidder may be disqualified, and its bid proposal not considered, for any of the following specific reasons, among others:
• Reason for believing collusion exists among bidders.
• Reasonable grounds for believing that any bidder is interested in more than one proposal for the work contemplated.
• The bidder being interested in any litigation against the City.
• The bidder being in arrears or default on any existing contract or having defaulted on a previous contract.
• Uncompleted work which, in judgment of the City, will prevent or hinder the prompt completion of additional work if awarded; or
• Bids in which prices are obviously unbalanced.
Bidders should carefully examine the plans, specifications and other documents, visit the site of the work, and fully inform themselves as to all conditions and matter which can in any way affect the work or the cost thereof. Should a bidder find discrepancies in or omissions from the plans, specifications or other contract documents or require further information interpretation, the bidder must make request for such information in writing to the Engineer prior to five (5) working days before the bid opening. Answers to all such requests will be given in writing to all bidders, by addenda, and all addenda will be made part of the contract and shall be acknowledged by the bidder in the space provided in the bid proposal form.
Unless the City elects to reject all bids, the Notice of Award of Contract shall be given as promptly as possible on the basis of the lowest responsible bidder.
After bids have been opened and prior to making an award, the City reserves the right to require any bidder to furnish a statement of bidder’s construction experience, organization and staff for the work completed.
HDR Job No. 10404407 ITB-3
The City shall have the right to take such steps as it deems necessary to determine the ability of the bidder to perform the work, and the bidder shall furnish the City all such information and data for this purpose as the City may request. The right is reserved to reject any bid where an investigation of the evidence or information submitted by such bidder does not satisfy the City that the bidder is qualified to properly carry out the terms of this Contract.
A copy of the bidder’s most recently prepared financial statement and statement of qualifications and references must be provided if requested by the City. This statement will be retained and examined only if the bidder’s bid is actively considered for award.
The conditions of the contract include provisions that require the successful bidder, within ten (10) calendar days after receipt of contract documents, to provide and execute a Performance and Payment
Bond, each in the amount of One Hundred Percent (100%) of the total contract price, for satisfactory performance of the contract and to guarantee payment of all lawful claims for labor performed and materials furnished in fulfillment of the contract.
Bidders should note that the City of Angleton is a holder of a Sales Tax Exemption Certificate and thus the Contractor shall not collect sales and use taxes attributable to tangible personal property to be incorporated into the work. Bidders are required to exclude such taxes from their bid and to state separately that part of the bid, which will be tangible personal property (hereinafter called
“Materials”).
Any alterations, additions, or deletions, to either the Instructions to Bidders or the Bid Proposal Form shall constitute the bid as unacceptable.
Nominal Quantities and Minimum Unit Prices have been established for Supplemental Items if shown in Bid Proposal. The Contractor may not bid a unit price less than the minimum value; however, they may increase the minimum unit price. If no entry is made in the space provided, the minimum unit price shown shall apply. These items are included to facilitate payment of changes and alterations that may be required to complete work. The actual work as provided by General and Special Conditions of the Agreement and Technical Specifications and shown on Plans is described in Bid Proposal Items other than Supplemental Pay Items. When work covered by Supplemental Items is required and approved by the City, Payment will be based on the quantity actually constructed and unit prices bid in Bid Proposal.
