About this file

This Special Terms and Conditions document outlines the procurement requirements for the Commonwealth of Virginia, specifically for the Department of Forensic Science. The solicitation establishes a 120-day bid acceptance period, during which bidders must maintain valid offers. All equipment must be fully assembled, installed, and ready for use upon delivery, with all crating and debris removed from the premises. The contractor must provide complete operations and maintenance manuals including wiring diagrams, parts lists, and warranty documentation with each piece of equipment. Within the first 90 days after contract award, the Department of Forensic Science may place additional orders at the original unit price, with aggregate additional orders not to exceed 100 percent of the originally stated contract quantity.

The Commonwealth prioritizes awards to DSBSD-certified micro businesses for bids up to $10,000 and DSBSD-certified small businesses for bids not exceeding $100,000, provided the agency determines the pricing is fair and reasonable. If neither set-aside category yields qualified bids, the award goes to the lowest responsive and responsible bidder of any size. All bid prices must be inclusive of complete installation, freight charges, and all applicable costs, with no extra charges permitted. The contract includes a 12-month warranty covering all materials and equipment against defects in material and workmanship. Contractors must participate in Virginia's eVA eProcurement Program and provide electronic catalogs or Punch-Out Catalogs for awarded items. The Commonwealth reserves the right to relocate equipment at its own expense and may require contractor supervision with 30 days' notice and reasonable compensation negotiated between parties.

If applicable, unit prices, extensions and grand total must be shown. In case of arithmetic errors, the unit price will govern. If cash discount for prompt payment is offered, it must be clearly shown in the space provided. Discounts for early prompt payment will not be considered in making awards. The State reserves the right to reject any and all bids in whole or in part, to waive any informality, and to delete items prior to making an award.

2. BID ACCEPTANCE PERIOD: Any bid in response to this solicitation shall be valid for (120) days. At the end of the days the bid may be withdrawn at the written request of the bidder. 8. PRODUCT INFORMATION: The bidder shall clearly and specifically identify the product being offered and enclose complete and detailed descriptive literature, catalog cuts and specifications with the bid/proposal to enable the Commonwealth to determine if the product offered meets the requirements of the solicitation. Failure to do so may cause the bid/proposal to be considered nonresponsive.

9. RELOCATION OF EQUIPMENT: Should it become necessary to move equipment covered by this contract to another location, the Commonwealth reserves the right to do so at its own expense. If

Contractor supervision is required, the Commonwealth will provide prior written notice of the move at mailto:eVA-catalogmanager@dgs.virginia.gov least thirty (30) days in advance, in which case the Contractor shall provide the required services and be reasonably compensated by the Commonwealth. If the contractor is required to correct or replace, it shall be at no cost to the Commonwealth and shall be subject to all provisions of this clause to the same extent as materials initially delivered.
