About this file
This is a Special Notice of Intent to Issue a Sole-Source Award from the Department of Veterans Affairs (VA). The VA's Consolidated Mail-Out Pharmacy (CMOP) in Lancaster, Texas, intends to negotiate a firm-fixed-price sole-source contract with Atos Medical for brand-name Provox medical and surgical supplies. The contract will be awarded under GSA Federal Supply Schedule Contract No. 36F79722D0056 and follows the authority of FAR 6.103-1, FAR 8.4, FAR 10.001(f), 10 U.S.C. 3204(a)(1), 41 U.S.C. 3304(a)(1), and GSA Ordering Procedures 538.7104-3(b)(ii)–(iii).
The sole-source justification is based on Provox products being prescribed by VA physicians for specific clinical needs with no allowable substitutions due to brand-specific and dispense-as-written requirements. The VA's Pharmacy Benefits Management (PBM) uses CMOP identifiers in the National Drug File as official product identifiers, and in certain cases, only one manufacturer part number meets the required formulation or composition. The award represents the best value and qualifies as a logical follow-on to previous Atos Medical orders under the Federal Supply Schedule, ensuring product consistency, interoperability, and avoiding unnecessary duplication of effort or expense. The contracting office is located in Leavenworth, Kansas (zip code 66048-5012), and interested vendors may contact Contract Specialist Jennifer Knight at Jennifer.Knight@va.gov or 913-684-0162 regarding similar future requirements. This notice does not solicit quotes.

DESCRIPTION
SPECIAL NOTICE OF INTENT TO ISSUE A SOLE SOURCE AWARD
This is not a request for quotes. This notice serves to inform interested parties that the Government intends to make a sole source award.
The Department of Veterans Affairs (VA), Consolidated Mail-Out Pharmacy (CMOP) in Lancaster, Texas, plans to negotiate a firm-fixed-price, sole-source contract with Atos Medical.
This action is being taken under the authority of RFO FAR 6.103-1, RFO FAR 8.4, RFO FAR 10.001(f), 10 U.S.C. 3204(a)(1), 41 U.S.C. 3304(a)(1), and RFO GSA Ordering Procedures
538.7104 3(b)(ii)–(iii). The requirement is for brand name Provox medical and surgical supplies.
These Provox products are prescribed by VA physicians to meet specific clinical needs.
Pharmacy staff cannot modify or substitute prescribed items. A “brand specific” designation functions as “dispense as written,” meaning no substitutions for the manufacturer part number (MPN) are allowed. Within the VA, Pharmacy Benefits Management (PBM) uses CMOP identifiers in the National Drug File as the official product identifiers (under the VA Print Name) to ensure accurate dispensing. In some cases, PBM clinical review has determined that only one MPN meets the product code’s required formulation or composition.
This procurement represents the best value under RFO FAR 10.001(f)(1) and follows the GSA Federal Supply Schedule ordering procedures at RFO FAR 8.4. It also meets the justification requirements for a sole source action under RFO GSA Subpart 538.7104 3(b)(iii). Under RFO GSA ordering procedures 538.7104 3(b)(iii), this acquisition qualifies as a sole source award because it is a logical follow on to previous orders placed with Atos Medical under the Federal Supply Schedule. Continuing with the original equipment manufacturer (OEM) maintains product consistency, interoperability, and avoids unnecessary duplication of effort or expense.
Atos Medical is the OEM and holds GSA Federal Supply Schedule Contract No.
36F79722D0056, under which all required items are available.
This notice does not solicit quotes. Interested vendors may contact Network Contracting Office (NCO) 15 to express their ability to support similar future requirements. Please direct inquiries to Jennifer Knight at Jennifer.Knight@va.gov.
