JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

1. Defense Logistics Agency (DLA) Troop Support, Construction and Equipment (C&E) Supply Chain, is the contracting activity.

2. The action being approved is the ability to solicit for supplies on an Other than Full and Open Competition basis.

3. The following item is required to meet DLA’s needs:

Item Description: CYLINDER, COMPRESSED GAS National Stock Number (NSN): 8120-01-602-0605 Manufacturer/Supplier: Scott Technologies, Inc. (Cage: 15927) Manufacturer/Supplier Part Number: P/N 804722-31 Annual Estimated Quantity: 1,706 each Estimated Unit Price: $1,490.00 each Estimated Dollar Value: $2,541,940.00(One (1) year Base) Number of one-year options: Four (4) Estimated Total Dollar Value, inclusive of options: $12,709,700.00 Maximum Total Dollar Value: $15,000,000.00

4. The applicable statutory authority permitting other than full and open competition is 10 U.S.C.

§ 3204(a)(1), as implemented by FAR 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.

5. The use of this authority is necessary because Scott Technologies, Inc is the Original Equipment Manufacturer (OEM) of the required Compressed Gas Cylinder. As the OEM, Scott Technologies is the owner of the technical data for this item and there is no access to this technical data. Used by the United States Navy, the compressed cylinder is a breathing air compressed gas cylinder which offers emergency respiratory protection in hazardous atmospheres. The cylinder is filled with compressed gas, at 4500 pounds per square inch (PSI), used for entry into or escape from hazardous, confined spaces, or immediately dangerous to life or health situations, i. e. environments with little or no oxygen, with high concentrations of contaminants, or where concentrations of contaminants are unknown

While commercial gas cylinders exist with similar performance and functionality, only the Scott Technologies compressed gas cylinder will satisfy the needs of the customer for the following reasons: the Scott Technologies compressed gas cylinder includes a modification to the cylinder’s retention bracket which allows the cylinder to attach/lock into the end item, the Self- Contained Breathing Apparatus (SCBA). The cylinder specified is only for use with the end item, also manufactured by Scott Technologies Inc., and no other cylinder is compatible with the SCBA. Per the request of the Technical Warrant Holder at Naval Sea System Command, Scott Technologies reduced the length of the bracket to allow the base of the cylinder to align closer to the wearer’s back. This greatly aides in transitioning scuttles commonly found aboard US Naval vessels. This compressed gas cylinder also provides a thirty (30) year life span, while comparable commercially available gas cylinders generally have a life span of fifteen (15) years

6. The solicitation will be posted to the DLA Internet Bid Board System (DIBBS) and will be synopsized in Contract Opportunities at SAM.gov in accordance with FAR 5.2. In addition, this J&A will be posted with the solicitation in accordance with FAR 6.305(c).

7. As the Contracting Officer, I hereby determine the anticipated cost to the Government will be fair and reasonable based on price analysis techniques in accordance with FAR 15.404-1(b)(2), specifically favorable comparison to historical prices paid for similar items, and an analysis of other than certified cost or pricing data.

8. On January 10, 2024, a Sources Sought Notice was issued for a period of thirty (30) days, through the Contract Opportunities website. No responses were received. Market Research Surveys were emailed to Scott Technologies and ADS Inc and were completed and returned

9. There are no other facts supporting the use of the authority for other than full and open competition.

10. ADS Inc., and the OEM, Scott Technologies, have expressed an interest in this acquisition by completing and returning the market research survey

11. DLA Troop Support will continue to perform market research prior to any future acquisitions for this requirement. In an effort to overcome barriers to competition, the solicitation for this requirement will contain DLAD Procurement Notes M06, Evaluation of Offers for Part Numbered Items and L04, Offers for Part Numbered Items, to encourage the submission of offers for alternate products. Any alternate offers received will be forwarded to the Product

Specialist for evaluation then sent to the Engineering Support Activity (ESA) for further review and final approval.
