SURPLUS CONTAINERS ARE NOT ACCEPTABLE FOR THIS REQUIREMENT
NEW OR ONE-TIME USE CONTAINERS
Delivery of either “new” or “one-time use” containers is acceptable for purposes of this requirement, in accordance with the following:
“New” containers are newly manufactured containers shipped in an empty condition, without payload, from the location of origin and/or manufacture to the destination specified for delivery below. Transshipment is not prohibited for new containers. However, while new containers may pass through intermediate ports on their way to the port of destination, they must do so wholly and consistently in an empty condition, without payload.
“One-Time Use” containers are newly manufactured containers that have been loaded with payload exactly once during their shipment from the location of manufacture to the destination specified for delivery below. Transshipment is not prohibited for one-time use containers. However, while one-time use containers may pass through intermediate ports on their way to the port of destination, they may be loaded with payload only once, whether by full container load or less-than-container load. Once payload has been added to the containers at one port, additional payload shall not be added at a separate port of call. Should additional payload be added at a separate port of call from the port at which payload was first packed into the containers, the containers shall no longer be deemed “one-time use,” shall be deemed non-conforming, and shall not be delivered under the terms of any resultant contract. One-time use containers shall arrive at the location specified for delivery empty, and in good and merchantable condition, with only minor visible defects or wear and tear representing a container condition at least as good as that which is commonly recognized throughout the shipping container industry as applying to one-time used containers.
The Contractor shall comply with all applicable Federal, State, and local/international laws, executive orders, and rules and regulations in shipping “new” or “one-time use” containers under the terms of any resultant contract. The Contractor agrees and acknowledges that it is in no sense an agent of the Government for purposes of its shipment and delivery of containers under the terms of any resultant contract. The Contractor shall indemnify and hold harmless the Government, its officers, employees, and agents, at the Contractor’s sole expense, from and against any and all claims, actions, suits, legal proceedings, or other liability, including but not limited to claims for costs or attorney’s fees related to or arising out of its provision or attempted provision of “one-time use” containers which result from events occurring at any time prior to the completed delivery of such one-time use containers at the FOB

point stipulated in the resultant contract.
TRANSPORTATION OF SUPPLIES BY SEA
The requirements of DFARS 252.247-7023 apply to each and every instance of transportation of the required containers by sea during performance of the resultant contract. Consistent with that clause, the Contractor shall, within 30 days after each shipment delivered under any resultant contract, provide the Contracting Officer and the Maritime Administration, Office of Cargo Preference, U.S. Department of Transportation (400 Seventh Street SW, Washington, DC 20590) one copy of the rated on board vessel operating carrier(s)'s ocean bill(s) of lading, which shall contain the following information: (1) Prime contract number; (2) Name of vessel; (3) Vessel flag of registry; (4) Date of loading; (5) Port of loading; (6) Port of final discharge; (7) Description of commodity; (8) Gross weight in pounds and cubic feet if available; (9) Total ocean freight in U.S. dollars; and (10) Name of steamship company. For purposes of satisfying the requirement of providing a copy of the ocean bill of lading to the Contracting Officer, please send said copy to ha.dang@dla.mil.
If the Contractor enters into subcontracts, lease agreements, or any other arrangements under which the contractor relinquishes physical control of the containers being delivered under this purchase order, the Contractor shall flow down the requirements of the clause at DFARS 252.247-7023 in its subcontracts, leases, or other arrangements.
Subcontracts, lease agreements or other arrangements do not negate the contractor’s responsibility to comply with all of the requirements set forth in DFARS 252.247-7023, Transportation of Supplies by Sea. Among other things, the Contractor shall arrange with any necessary parties, in advance, for copies of the rated on board vessel operating carrier’s ocean bill(s) of lading, compliant with the above requirements, to be transmitted to the Contracting Officer and the Maritime Administration, Office of Cargo Preference, U.S. Department of Transportation within 30 days after each shipment delivered under the resultant contract and any related subcontracts, lease agreements, or other arrangements.
With respect to bills of lading for the shipment of “one-time use” containers shipped without government-issued serial numbers affixed, specific information regarding any third-party payload being shipped within the containers and/or confidential business information associated with such payload may be redacted from the bills of lading, provided that the bills of lading contain all information required under DFARS 252.247-7023(e). However, bills of lading for “one-time use” containers shipped WITH government-issued serial numbers affixed may not be redacted in any respect. It is the Contractor’s sole responsibility to ensure that all shipment carriers and involved third-parties are fully aware of and comply with these requirements.
A copy of an ocean bill of lading is required for each and every instance of transportation of the required containers by sea during performance of the resultant contract. This includes each and every leg of shipment from the point of origin to the final customer destination in which the containers are transported by sea.
Alternative forms of documentation will not be accepted in lieu of rated on board vessel operating carriers’ ocean bills of lading.
If no ocean transportation was used in the performance of the contract, the contractor shall provide, in lieu of ocean bill(s) of lading, an explanation as to where the containers were manufactured, how they were transported, and why transportation by sea was not required for delivery. In addition, for supplies not manufactured by the contractor, the contractor shall provide supply chain traceability documentation establishing the following: basic item description, part number and/or national stock number, manufacturing source, manufacturing source’s Commercial and Government Entity (CAGE) code, manufacturer’s serial numbers or other individually identifying item markings, dates of purchase and receipt into inventory, location stored in inventory, and clear identification of the name and location of all supply chain intermediaries from the manufacturer, through the contractor, to the point of acceptance by the Government. The contractor shall send its explanation and supporting documentation to ha.dang@dla.mil within 30 days after each shipment delivered under any resultant contract.

Please be advised that the items to be acquired under this solicitation are deemed to consist “predominantly of iron or steel or a combination of both” within the definition of that term under DFARS 252.225-7001. Accordingly, an offered end product is a “foreign end product” for purposes of that clause, as well as the corresponding provision at DFARS 252.225-7000, (and must be certified as such) if the cost of iron and steel not produced in the United States or a qualifying country (exclusive of COTS fasteners) amounts to five percent or more of the cost of all components used in the manufacture of the end product. Such is the case regardless of whether the end product is manufactured in the United States, and regardless of whether the end product would otherwise qualify as a commercially available off-the-shelf (COTS) item. Please consult the clause at DFARS 252.225-7001 for further details and information.
252.225-7001 Buy American and Balance of Payments Program.
Basic. As prescribed in 225.1101(2)(i) and (2)(ii), use the following clause:
BUY AMERICAN AND BALANCE OF PAYMENTS PROGRAM—BASIC (Feb 2024)
(a) Definitions. As used in this clause—
“Commercially available off-the-shelf (COTS) item”—
(1) Means any item of supply (including construction material) that is—
(i) A commercial product (as defined in paragraph (1) of the definition of “commercial product” in section 2.101 of the Federal Acquisition Regulation (FAR));
(ii) Sold in substantial quantities in the commercial marketplace; and
(iii) Offered to the Government, under a contract or subcontract at any tier, without modification, in the same form in which it is sold in the commercial marketplace; and
(2) Does not include bulk cargo, as defined in 46 U.S.C. 40102(4), such as agricultural products and petroleum products.
“Component” means an article, material, or supply incorporated directly into an end product.
“Critical component” means a component that is mined, produced, or manufactured in the United States and deemed critical to the U.S. supply chain. The list of critical components is at FAR 25.105.
“Critical item” means a domestic construction material or domestic end product that is deemed critical to the U.
S. supply chain. The list of critical items is at FAR 25.105.
“Domestic end product” means—
(1) For an end product that does not consist wholly or predominantly of iron or steel or a combination of both—
(i) An unmanufactured end product mined or produced in the United States; or
(ii) An end product manufactured in the United States if—
(A) The cost of its qualifying country components and its components that are mined, produced, or manufactured in the United States exceeds 60 percent of the cost of all its components, except that the percentage will be 65 percent for items delivered in calendar years 2024 through 2028 and 75 percent for items delivered starting in calendar year 2029, unless an alternate percentage is established for a contract in accordance with FAR 25.101(d), or award is made before January 1, 2030, for a foreign end product that exceeds 55 percent domestic content (see Defense Federal Acquisition Regulation Supplement 225.103(b)(ii)). The cost of components includes transportation costs to the place of incorporation into the end product and U.S. duty (whether or not a duty-free entry certificate is issued). Components of unknown origin are treated as foreign. Scrap generated, collected, and prepared for processing in the United States is considered domestic. A component is considered to have been mined, produced, or manufactured in the United States (regardless of its source in fact) if the end product in which it is incorporated is manufactured in the United States and the component is of a class or kind for which the Government has determined that—
(1) Sufficient and reasonably available commercial quantities of a satisfactory quality are not mined, produced, or manufactured in the United States; or
(2) It is inconsistent with the public interest to apply the restrictions of the Buy American statute; or
(B) The end product is a COTS item; or
(2) For an end product that consists wholly or predominantly of iron or steel or a combination of both, an end product manufactured in the United States, if the cost of iron and steel not produced in the United States or a qualifying country constitutes less than 5 percent of the cost of all the components used in the end product (produced in the United States or a qualifying country means that all manufacturing processes of the iron or steel must take place in the United States or a qualifying country, except metallurgical processes involving refinement of steel additives). The cost of iron and steel not produced in the United States or a qualifying country includes but is not
PAGE 6 OF 26 PAGES
limited to the cost of iron or steel mill products (such as bar, billet, slab, wire, plate, or sheet), castings, or forgings, not produced in the United States or a qualifying country, utilized in the manufacture of the end product and a good faith estimate of the cost of all iron or steel components not produced in the United States or a qualifying country, excluding COTS fasteners. Iron or steel components of unknown origin are treated as foreign. If the end product contains multiple components, the cost of all the materials used in such end product is calculated in accordance with the explanation of cost of components in paragraph (1)(ii)(A) of this definition.
“End product” means those articles, materials, and supplies to be acquired under this contract for public use.
“Foreign end product” means an end product other than a domestic end product.
“Predominantly of iron or steel or a combination of both” means that the cost of the iron and steel content exceeds 50 percent of the total cost of all its components. The cost of iron and steel is the cost of the iron or steel mill products (such as bar, billet, slab, wire, plate, or sheet), castings, or forgings utilized in the manufacture of the product and a good faith estimate of the cost of iron or steel components excluding COTS fasteners.
“Qualifying country” means a country with a reciprocal defense procurement memorandum of understanding or international agreement with the United States in which both countries agree to remove barriers to purchases of supplies produced in the other country or services performed by sources of the other country, and the memorandum or agreement complies, where applicable, with the requirements of section 36 of the Arms Export Control Act (22 U.S.C.
2776) and with 10 U.S.C. 2457. Accordingly, the following are qualifying countries:
Australia Austria Belgium Canada Czech Republic Denmark Egypt Estonia Finland France Germany Greece Israel Italy Japan Latvia Lithuania Luxembourg Netherlands Norway Poland Portugal Slovenia Spain Sweden Switzerland Turkey United Kingdom of Great Britain and Northern Ireland.
“Qualifying country component” means a component mined, produced, or manufactured in a qualifying country.
“Qualifying country end product” means—
(1) An unmanufactured end product mined or produced in a qualifying country; or
(2) An end product manufactured in a qualifying country if —
(i) The cost of the following types of components exceeds 50 percent of the cost of all its components:
(A) Components mined, produced, or manufactured in a qualifying country.
(B) Components mined, produced, or manufactured in the United States.
(C) Components of foreign origin of a class or kind for which the Government has determined that sufficient and reasonably available commercial quantities of a satisfactory quality are not mined, produced, or manufactured in the United States. Components of unknown origin are treated as foreign; or
(ii) The end product is a COTS item.
“United States” means the 50 States, the District of Columbia, and outlying areas.
“Steel” means an alloy that includes at least 50 percent iron, between 0.02 and 2 percent carbon, and may include other elements.
(b) This clause implements 41 U.S.C chapter 83, Buy American. In accordance with 41 U.S.C. 1907, the component test of the Buy American statute is waived for an end product that is a COTS item (see section 12.505(a)(1) of the Federal Acquisition Regulation). Unless otherwise specified, this clause applies to all line items in the contract.
(c) The Contractor shall deliver only domestic end products unless, in its offer, it specified delivery of other end products in the Buy American—Balance of Payments Program Certificate provision of the solicitation. If the Contractor certified in its offer that it will deliver a qualifying country end product, the Contractor shall deliver a qualifying country end product or, at the Contractor’s option, a domestic end product.
(d) The contract price does not include duty for end products or components for which the Contractor will claim duty-free entry.
(End of clause)
